TheState Personnel Board (Board)is an independent constitutional entity created by Art. XII Sec. 14(1) of the Colorado Constitution. Pursuant to Article XII Section 14(3) the Board promulgates rules governing the state personnel system. Pursuant to Article XII Section 13(8) the Board hears appeals by certified state employees of disciplinary actions. Pursuant to Section(5) of the Colorado Revised Statutes the Board also hears appeals by certified state employees of adverse actions that affect base pay status or tenure. The Board may also use its discretion to grant a hearing when it appears that: (A) an employment action violates the Colorado Anti-Discrimination Act (commonly referred to as CADA); (B) an employment action violates the State Employee Protection Act (commonly referred to as the Whistleblower Act); (C) a final grievance decision violates an employees rights under the federal or state constitutions; (D) a final grievance decision violates an employees rights under the grievance procedures; (E) a final decision of the State Personnel Director violates a rule or statute relating to the comparative analysis process; or (F) a final decision of the State Personnel Director on a matter involving the overall administration of the state personnel system is arbitrary capricious or contrary to rule or law.
The Board consists of five members two elected by certified state employees and three appointed by the Governor. The Board staff consists of three part time Administrative Law Judges a Senior Board Assistant and the Board Director.
The Board is a Type 1 entity that exercises its powers and performs its duties independently but operates under the administration of the Department of Personnel & Administration.

Appeal Rights:
An applicant who has been removed from an employment list or removed from consideration during the selection process may request a review by the State Personnel Director.
As an applicant directly affected by the results of the selection or comparative analysis process you may file a written appeal with the State Personnel of the completed signed and submitted appeal will be timely on the basis of written material submitted by you using the official appeal form signed by you or your representative. This form must be completed and delivered to the State Personnel Board by email atwithin ten (10) calendar days from your receipt of notice or acknowledgement of the Departments action.
