La démocratie implique une structure dinstitutions et de pouvoirs publics combiné à une méthode de gouvernance. Tant cette structure que la forme de gouvernance qui laccompagne reposent sur la légitimité de lÉtat le consentement du peuple lapplication de la règle de droit et le respect des droits des personnes. Cest le type de gouvernement qui existe au Canada. Ce cours a pour objet de définir le sens juridique de la démocratie et de ses concepts de base. Il vise à: (1) faire un survol des sujets dactualité des institutions et des types dinstruments où la démocratie est en jeu; (2) établir un compte rendu des lois pertinentes; (3) analyser les mécanismes dinteraction entre le droit les politiques publiques et la pratique politique qui sont applicables à la gouvernance étatique; (4) définir la reddition de comptes envers le droit de lÉtat de ses institutions et de ses agents; (5) identifier les développements les plus récents en matière de démocratie; et (6) examiner les recours particuliers à cette branche du droit.

Requirements:

La Section de common law veut recruter des professeurs à temps partiel qui sont des leaders dans la profession juridique. Pour ce cours un LL.B. ou un J.D. (ou son équivalent) est nécessaire. Le candidat ou candidate doit aussi être membre en bonne et due forme du Barreau de lOntario (ou son équivalent). Il ou elle doit aussi avoir une expérience significative dans ce domaine. Le fait davoir enseigné ce cours auparavant est un atout.

À sa discrétion la Section de common law se réserve le droit de sélectionner un postulant ne répondant pas entièrement aux critères de laffichage si sa sélection serait dans lintérêt du programme du cours des étudiants ou une autre justification connexe.
