Essential Duties And Responsibilities
Appalachian State University is seeking a Chief Compliance and Ethics Officer to oversee the Office of Compliance and Ethics in the implementation operation and oversight of an enterprisewide compliance program. The primary purpose of The Office of Compliance and Ethics is to support the Divisions efforts by promoting and supporting an academic and working environment that reflects the universitys commitment to maintaining the highest level of integrity and ethical standards in the conduct of the operations. The primary role of the Chief Compliance and Ethics Officer is to oversee the Office of Compliance and Ethics in the implementation operation and oversight of an enterprisewide compliance program at Appalachian State University to ensure the universitys full adherence to the legal ethical and regulatory obligations imposed by all levels of government and other oversight agencies. The Office of Compliance and Ethics is located on App States Hickory Campus in Hickory N.C. The Chief Compliance and Ethics Officer will connect both virtually and periodically in person with stakeholders on App States main campus in Boone N.C. to carry out the responsibilities of the position. Compliance Management 40 Establish and oversee a continuous proactive and comprehensive compliance program. Establish compliance standards policies and procedures to prevent and detect inappropriate (or encourage appropriate) conduct and facilitate compliance. Direct and collaborate in the development of compliance education and training programs. Ensure that the compliance program is followed monitoring and auditing and periodically evaluating the programs effectiveness. Provide strategic guidance and representation to leadership on changing governmental requirements. Direct and oversee the Universitys integrated strategic compliance planning process. Lead the development and implementation of policies and procedures related to the various compliance areas of oversight in alignment with government laws and regulations. Develop an ongoing program to heighten awareness of the various University campus compliance programs. Campus/Community Relations 30 Communicate standards procedures and other information regarding the compliance program in a practical manner to all members of the University. Provide regular training on rules regulations and University policies. Provide and publicize a reporting system that allows for anonymity and confidentiality. Respond to noncompliance if discovered by taking the appropriate steps and responding in matters that would prevent similar conduct in the future. Serve as primary pointofcontact regarding the universitys policy development and revision process. Advise on the possible interaction between proposed policies with other existing policies outlined in the university and UNC System policy. Interact with senior management faculty staff and government agency officials to represent and promote the development of strategic compliance programs. Project Management and Strategy 30 Maintain a professional staff with sufficient knowledge skills experience competencies and professional certifications for Enterprise Risk Management Clery Act Compliance and provide oversight of these areas. Promote and enforce the compliance program consistently using appropriate incentives for compliance and developing disciplinary measures for noncompliance criminal conduct or failure to take reasonable steps to prevent and detect inappropriate conduct. Develop a comprehensive knowledge of higher educationrelated compliance functions; research and analyze policy concepts complex policy issues possible legal implications and the impact of proposed policies and policy revisions on key areas of the institution. Plan develop monitor revise and implement the universitys compliance initiatives in response to changes in the law. Develop an ongoing program to heighten awareness of the various University campus compliance programs. Oversee adequate record maintenance and that processes are in place to document compliance efforts. The Office of Compliance and Ethics is part of the Division of Institutional Integrity. The Division of Institutional Integrity supports Appalachian State University by driving a campus culture of compliance and facilitating the Universitys ability to maximize strategic opportunities while minimizing liability exposure. This allows the University to achieve its academic mission and strategic plan while adhering to ethical legal and regulatory responsibilities thus creating a unique environment to comply with the extensive regulations and administrative oversight applicable to operations. The Office of Compliance and Ethics supports the Divisions efforts and this position will provide an integral role in support of the Universitys mission and will be responsible for the implementation operation and oversight of an enterprisewide compliance program at Appalachian State University to ensure the universitys full adherence to the legal ethical and regulatory obligations imposed by all levels of government and other oversight agencies.
Minimum Qualifications
Demonstrated ability to advise senior management and governing board on enterpriselevel compliance risks. Ability to use independent judgment and to manage and impart confidential information. Knowledge of current emerging higher educationrelated legislation issues and trends. Knowledge of public policies legislation guidelines and standards pertaining to discrimination and sexual harassment in the workplace. Supervisory employee development and leadership skills. Strong critical thinking skills and the ability to analyze summarize and effectively present data. Strong written and verbal communication skills. Strong interpersonal and communication skills and the ability to work effectively with a wide range of constituencies in a diverse community. Strong analytical evaluative and objective critical thinking skills. Ability to interpret and advise on the application of various laws and regulations. Knowledge and understanding of investigation negotiation mediation and complaint resolution process of highlevel sensitive claims on behalf of a public institution of higher education. Knowledge of teambuilding principles and techniques.
Preferred Qualifications
J.D. combined with four years of relevant experience. 35 years experience in a university environment or highly regulated industry with compliance and/or policyrelated responsibilities. Knowledge of the operation of the UNC system.
