The Commercial Expert Mexico is responsible for providing senior level commercial contractual and financial oversight from feasibility to implementation for all WIFA project components executed in Mexico or involving cross border commercial interfaces. The role ensures that construction engineering procurement and service contracts are structured negotiated administered and managed in alignment with WIFA commercial objectives and contract requirements ACCIONA risk standards and applicable Mexican regulations.

This position plays a critical role in supporting early engagement assessments and decision making bid development early works feasibility and construction delivery ensuring commercial risks are identified early and actively managed throughout the project lifecycle. The Commercial Expert works closely with the Project Director Program Manager Construction Lead Mexico Technical Experts Finance and Legal teams to protect project value manage claims and maintain contract compliance across all Mexico based scopes.

Job Description

Commercial & Contract Strategy

  • Lead commercial strategy development for Mexicobased scopes including construction EPC subcontracting and vendor agreements.

  • Support development of commercial models scope allocations and riskreward structures during feasibility and early works.

  • Ensure alignment of Mexican contracts with overall WIFA program commercial strategy and crossborder agreements.

Contract Negotiation & Administration

  • Support or lead development and negotiation of contracts amendments and change orders with contractors subcontractors and suppliers in Mexico.

  • Oversee contract approach for administration activities ensuring compliance with commercial terms payment provisions bonding and guarantees.

  • Monitor contractual obligations deliverables and milestones across Mexican work packages.

Cost Control & Financial Oversight

  • Work with project controls and finance teams to develop budgets track costs commitments forecasts and earned value for Mexicobased scopes.

  • Review and validate contractor payment applications variations and commercial claims.

  • Support budget control cashflow monitoring and financial reporting inputs related to Mexican activities.

Claims Variations & Risk Management

  • Identify assess and manage commercial risks claims and disputes arising from construction and service contracts.

  • Support preparation and negotiation of variation orders extensions of time and claims mitigation strategies.

  • Coordinate with Legal and Project Leadership on dispute resolution strategies as required.

CrossBorder & Regulatory Coordination

  • Ensure contracts comply with applicable Mexican commercial labor tax and regulatory requirements while maintaining alignment with WIFA contractual frameworks.

  • Support coordination between U.S. and Mexico teams on commercial interfaces currency exposure and crossborder payment mechanisms.

Governance Reporting & Stakeholder Support

  • Prepare commercial inputs for governance reviews investment committees and client reporting.

  • Support presentations and commercial briefings for WIFA stakeholders and internal ACCIONA leadership.

  • Contribute to continuous improvement of commercial processes and lessons learned for future WIFA phases.

Required Skills and Competencies

  • Bachelors degree in Business Engineering Construction Management Finance Law or related discipline.

  • Advanced degree or professional certifications (MBA commercial management contract law) preferred.

  • Proven experience in commercial or contract management on large infrastructure or industrial projects water infrastructure experience preferred.

  • Demonstrated experience managing construction and engineering contracts in Mexico.

Skills

  • Ability to work effectively with technical construction legal and finance teams.

  • High attention to detail with a proactive problemsolving mindset.
