Job Summary

Main Purpose of Job

The main purpose of this position is to enforce and increase voluntary compliance with Maryland protective labor and employment laws which fall under the responsibility of the Department of Labor.

This position is required to have demonstrated fluency (both oral and written) in both Spanish and English to communicate with Spanish-speaking constituents.

POSITION DUTIES

Investigation: Conductsinvestigations and examinations of potential labor standards violations inthe State. Performs this functionusing established investigative discovery methods and evidentiary analysisincluding conducting and documenting witness interviews identifyingcollecting and analyzing relevant information including statementsreports payroll and personnel policies and records and other requireddocumentation and evidence.

Evaluation: Evaluates and relates facts to compliancerequirements citing applicable labor laws and regulations for the purpose ofemployee empowerment preventing violations and public education. Performsthis function through direct in-person and telephone interviews writtencommunications and reviewing and analyzing documentary information and otherevidence.

Adjudication: Adjudicates labor law violations after consideringinvestigation results and document findings. Provides testimony duringhearings regarding decisions. Enforces decisions by issuing citationspenalties wage orders final wage orders subpoenas and other notices.

Outreach and Education: Provides consultation services to employersemployees and other interested persons to improve labor law compliance inthe state. Performs this function through written and oral communicationgroup presentations and collaboration with employers to establish labor lawcompliance programs.

Communication: Communicatesorally and in writing with employers employees colleagues and programmanagement and other interested persons for the purposes of identifying andinvestigating potential violations issuing enforcement documents obtaining compliance through approvedmethods (such as conciliation or settlement) and addressing inquiries frommembers of the public.

Report Writing: Prepares narrative reports detailing investigationsand follow-up activities.

Other Duties as Assigned: Performs allother duties assigned.

MINIMUM QUALIFICATIONS

Education: Graduation from an accredited high school or possession of a high school equivalency certificate.

Experience: Four years of general investigative work. Two years of the experience must have involved investigations for compliance to laws and regulations governing wages and/or employment practices.

Notes:

1. Candidates may substitute the possession of a Bachelors degree from an accredited college or university for the required years of experience.

2. Candidates may substitute the possession of an Associates degree from an accredited college or university for two years of the required general investigative work experience.

3. Candidates may substitute thirty (30) college credit hours from an accredited college or university for one year of the required experience not to exceed four (4) years of the required experience

4. Candidates may substitute U.S. Armed Forces military service experience as a non-commissioned officer in the inspection investigation enforcement and compliance classifications inspection investigation enforcement and compliance specialty codes in the wage and hour investigation field of work on a year-for-year basis for the required experience.

DESIRED OR PREFERRED QUALIFICATIONS

Preference will be given to applicantswho possess the following preferred qualification(s).Include clear and specific information on your application regardingyour qualifications.

Experience in governing wages or employment practices in human resources or investigations or management non-payment of wages and/or pay equity.

Report writing and investigative background experience.

Ability to speak and write fluent Spanish.

Experience reviewing researching and applying standards and regulation in a codified environment.

LICENSES REGISTRATIONS AND CERTIFICATIONS

Employees in this classification may be assigned duties which require the operation of a motor vehicle. Employees assigned such duties will be required to possess a motor vehicle operators license valid in the State of Maryland.

SPECIAL REQUIREMENTS

Employees in this classification may be required to have daily use of a motor vehicle while on official State business. Standard mileage allowance will be paid for use of a privately owned vehicle.

All candidates are subject to a background check against files maintained by the Division ofUnemployment Insurance (LABOR/DUI) to determine whether any monies are owed to LABOR/DUI asa result of unemployment overpayment/fraud. Any unpaid debt may have an impact on whether ornot a candidate is offered employment.
