Description of Work

The Division of Human Resources provides comprehensive human resources services for all NCDHHS employees providing support for employees in both divisions and facilities throughout North Carolina.

The position serves as the agencys Employee Relations (ER)/Equal Employment Opportunity (EEO) Program Manager and supervises the ER Consultant Team Supervisor EEO Coordinator and EEO/ER Compliance/Investigator positions reporting to the Senior Deputy Director for the Division of Human Resources. This position will manage the agencys ER and EEO programs and provide various forms of intervention including problem-solving mediation coaching counseling and training to facilitate a more harmonious work environment and ensure balanced and fair treatment of both management and individual employees. The position will manage disciplinary action performance management grievance document/letter approval and reasonable accommodation procedures and processes as well as conduct investigations when needed. This position will provide consultation and subject matter expertise on all ER and EEO policies and procedures as well as serve as a subject matter expert. Position serves as the Agency EEO Officer.

The ER/EEO Program Manager will be responsible for providing direction and operational effectiveness within the ER/EEO functions for the North Carolina Department of Health & Human Services. This position is also responsible for promoting and supporting workplace equal employment opportunity initiatives and collaborating with division leadership to respond to ER-related needs.

Leadership
This position manages and administers all aspects of a wide variety of diverse personnel policies and procedures related to Employee Relations including leading all Discipline and EEO Complaints; and serving as a support for RIF Furlough ADA and Grievances etc. This includes (1) evaluation analysis and decision making related to Employee Relations issues; (2) consultation with Division and Departmental Managers related to Employee Relations issues; (3) review and approval of all suspensions demotions dismissals investigatory placements and separations based on an independent review of the requested action (4) conduct investigations of a sensitive/confidential nature as directed; make decisions related to the course and extent of investigations; (5) consult on the development new or modify existing personnel policy and procedures interpret personnel policy resolve problems and questions related to employee relations and function as a personnel professional for a variety of personnel related issues; (6) review and approve: separations due to unavailability fitness for duty examinations resignations without written notice.

EEO Functions
This position is responsible for the direction of the EEO programs and policies and is charged with administering the provisions of state and federal equal employment opportunity laws and interpretation and application of policies and guidelines pertaining to the prohibition of unlawful discrimination harassment or retaliation in employment on the basis of race color sex (including gender identity sexual orientation and pregnancy) national origin religion age (40 or older) genetic information or disability. The position plans develops and implements the Equal Employment Opportunity Program in the agency which employs workers in a wide variety of positions including administrative professional technical research clerical and trade occupations. The incumbent reviews analyzes investigates monitors counsels and makes recommendations regarding personnel practices as they pertain to employees and applicants rights pertaining to equal employment law; conducts compliance reviews and investigations related to EEO and employee relations; provides remedies for non-compliance; and provides support statewide to facilities and divisions.

DHR Team Membership
As a member of the Human Resources management team this position will participate in the development of the strategic direction of the Human Resources Division in support of the DHHSs strategic plan; develop objectives in support of the strategic direction; ensure that subordinate staff achieve tasks related to objectives; and develop and manage ER/EEO human resources metrics to measure work activities and progress towards reaching objectives.

ER/EEO Guidance
The employee in this position is expected to have the ability to plan prioritize and supervise the work of HR coordinators supervisors consultants and investigators to include training cross training and setting expectations; the ability to interpret and apply personnel and department policies in complex sensitive or new situations as well as to assist in the development of policies and procedures consistent with Office of State Human Resources policies and state and federal laws; the ability to think analytically; to exercise judgment and discretion in the application and development of personnel policies procedures and programs; the ability to effectively communicate both orally and in written form with staff at all levels for the purpose of conducting investigations as well as advising consulting and training managers on various personnel policies in the program area managed; the ability to establish and maintain effective working relationships within and external to the agency to include relationships with DHHS/DOJ General Counsel OSHR and other State agencies; thorough knowledge of personnel and management principles and practices particularly in ER and EEO and particularly as they apply to DHHS programs and organization; considerable knowledge of the State and federal laws and regulations related to ER and EEO as well as the principles best practices and methodology of ER and EEO; considerable knowledge of agency policy directives and guidelines when consulting and advising individuals on personnel policy issues; thorough knowledge of EEO laws and policies; and the ability to analyze data identify problem areas and develop corrective action steps monitor program functions determine appropriate personnel action and to write comprehensive plans and reports.

  • Demonstrated experience in providing consultation to managers and employees on employee relations EEO and performance management;
