This position conducts approval activity for community-based essential safety net providers. BHA is the lead authority state agency on behavioral health and treatment provisions for essential safety net providers. This position is responsible for ensuring compliance with 2 CCR 502-1 and Colorado Revised Statutes of their assigned caseload. This position will provide technical assistance and support to Safety Net providers and applicants and collaborate with other state agencies on essential safety net provisions. This position provides oversight and monitoring to the states essential safety net providers to ensure regulatory compliance quality service provision health and safety and service accessibility.

Primary Job Duties:
Licensing Approval Inspection and Investigations of Safety Net Providers
This position provides licensing and/or designation for behavioral health agencies wishing to obtain BHAs approval of their safety net services for participation in the safety net program. It compares behavioral health rules statutes governing behavioral health services and BHAs policies and procedures to make determinations as to whether or not an agency should be approved for safety net services licensed for substance use disorder services or designated for mental health treatment. Collect interpret and report findings of audit processes to licensed or approved providers. This position is responsible for collecting the audit forms and findings of team members and interpreting results to communicate findings and any violations to the provider. Must ensure the accuracy of team members documentation. Physically inspect the facility for health safety and program standards to 2 CCR 502-1 and Title 27 of Colorado Revised Statutes. This position also conducts provider site visits to determine contract or license/designation compliance using a standardized risk-based protocol to look for indicators of quality assurance activities and compliance with BHA rules. These site visits may be conducted together with other work units within BHA and may happen concurrently with the provision of population-based technical assistance. Fieldwork travel is required.

Oversight Monitoring and Compliance of Safety Net Provider Caseload
This position oversees a caseload of providers for monitoring oversight and compliance in accordance with rules. For the immediate period this will includes providers licensed as Behavioral Health Entities or approved as safety net providers:
Maintain routine review of complaints and critical incident reports for providers on caseload.
Respond to public and stakeholder complaints concerns or reported regulatory negligence about providers.
Respond to and coordinate technical assistance training or challenges identified by the monitoring review by the provider.
Schedule routine visits of providers with a review of policy and procedure clinical guidelines clinical documentation and regulatory requirements review
Review quality data from providers and respond with training technical assistance or coaching as deemed appropriate.
Coordinate with other agencies on payment incentives or withholds as determined by quality and compliance for future value-based payment structures for safety net designated providers.
Provide routine updates on provider caseload to the Safety Net Associate Director and Director Licensing and Designation.
Provide aggregate summary data as requested to the BHA Advisory Council on provider grievances quality data or other items as appropriate.

Policy Essential Safety Net Licensure & Designation Regulations
This position is a primary author of regulation including licensure and designation requirements for Behavioral Health Safety Net Substance Use Controlled Substance and Behavioral Health Entity providers. This includes corresponding standards of practice and ongoing related legislation:
Coordinate with other relevant divisions within BHA to set policy standards of practice and licensure requirements for safety net providers.
Coordinate and receive input from other state agencies on policy standards of practice and licensure requirements for safety net providers.
Draft regulatory guidance.
Coordinate stakeholder engagement.
Draft responses to all written and oral stakeholder testimony.
Present draft rule to the Colorado Department of Human Services Board.
Works with the Policy Strategy and Communications group to maintain congruence in communication with CDHS/BHA and consults with that group regarding information that could benefit the public through online or web-based communication and media messaging.

Minimum Qualifications Substitutions Conditions of Employment & Appeal Rights

Minimum Qualifications
Experience Only:

Seven (7) years of relevant experience within behavioral healthcare.

OR

Education and Experience:

A combination of related education in and/or relevant experience within behavioral healthcare equal to seven (7) years.

Preferred Qualifications
  • Experience in regulatory oversight monitoring and compliance for healthcare or behavioral health providers.

  • Experience with licensing approval inspection or investigation activities for behavioral health care providers or similar entities.

  • Experience in policy or regulation development related to behavioral health licensure designation or standards of practice.

  • Experience in a leadership role

  • This position is delegated as a remote position. The employees must maintain a home office and workstation free of distraction.

  • The position is to travel to meetings and/or conferences as needed.

Absent extraordinary circumstances prior disciplinary termination or resignation in lieu of termination will disqualify the applicant from future State employment with CDHS.
