THE STARTING SALARY FOR THIS POSITION IS LIMITED TO $116147- $130266. Salary offers for the selected candidate are based on the candidates education and experience related to the position as well as our agency budget and equity.

The North Carolina Department of Justice led by the Attorney General of North Carolina represents the state state agencies and elected officials and defends the rights of the people of North Carolina. The Department handles all state criminal appeals cases and assists district attorneys with complex criminal cases at their request. Additionally the Department of Justice includes the North Carolina State Crime Lab the North Carolina Justice Academy and the Sheriffs and Criminal Justice Education and Training Standards Divisions.

The Service to State Agencies Section provides a full range of legal service including litigation before State and federal tribunals to a number of State agencies or agency components including the Administrative Office of the Courts the Department of Agriculture the Department of State Treasurer the Department of Natural and Cultural Resources the Office of State Human Resources the State Human Resources Commission the Credit Union Division of the North Carolina Department of Commerce the North Carolina Department of Information Technology and the Wildlife Resources Commission.

The Attorney V position is a senior attorney position that will:

(1) Provide legal services to the Judicial Branch of North Carolina including the Administrative Office of the Courts (AOC) and the Office of Indigent Defense Services (IDS).

In providing representation to the Judicial Branch this attorney represents elected and appointed officials both judicial and non-judicial and employees of the various offices within the Branch who are sued for actions taken pursuant to their employment in the Branch.

All of the responsibilities assigned to this attorney are handled independently and with minimal supervision. The litigation brought in the federal courts challenges practices and procedures having statewide implications for the Judicial Branch of government.

Overarching state process cases potentially result in complex class action litigation

involving defending a statutes constitutionality. This position is called upon by the AOCs senior management for legal counsel on policy and program matters. Elected judicial officials call upon this position for advice on personnel matters and the legal implications of interactions with the public and other elected officials. The advisory role performed by this position parallels and complements the advisory role performed by the AOCs general counsel.

(2) Advise DOJ senior management on policy and program matters involving interaction between the Judicial Branch and Executive Branch agencies.

(3) Serve as lead attorney and/or work collaboratively as a team member with another attorney who also provides legal services to the Judicial Branch.

(4) Provide such other legal services including the representation of the State in criminal appeals as may be assigned by the Office of the Attorney General. When there are resource shortages within the team or elsewhere with the Section and/or the Department this attorney may be asked to cover such cases and matters in addition to the normal caseload.

The Attorney V position must be a self-starter and assume full responsibility for the completion of all aspects of cases and other matters assigned by the Section Head and/or the Office of the Attorney General with minimal supervision. While possessing the ability to litigate independently at all levels of court the attorney must function well as a team player keep the internal and external stakeholders informed of critical matters and possess the ability to collaborative with others within the Section and AOC.

Possess excellent skills in problem solving and project management.

Licensed to practice law by the North Carolina State Bar and five years of progressively responsible professional legal experience.

NOTE: GS 114-2 and 114-6 make it the duty of the Attorney General of NC to represent the State of North Carolina in all litigation unless another statute specifically states otherwise.

Management prefers the following: Experience independently litigating complex cases in a variety of forums including administrative tribunals and State and Federal courts; and the ability to multi-task and prioritize case deadlines successfully.

Credit for foreign degrees will only be given if verification of degree certification is attached to your application. Transcripts for foreign degrees have to be evaluated by an organization like World Education Services to determine US equivalency.
