THE RECRUITMENT RANGE FOR THIS POSITION IS LIMITED TO $73208 to $83501.Salary offers for the selected candidate are based on the candidates education and experience related to the position as well as our agency budget and equity.

Primary Purpose of the Position
The Tort Claims section is seeking an Attorney IIto act as defense counsel for the various State agencies named in legal actions brought pursuant to the Tort Claims Act N.C. General Statutes 143-291 et seq.

Description of Work
This position is responsible for defending civil actions for serious personal injury wrongful death medical malpractice or property damage brought against State employees individually pursuant to the Tort Claims Act N.C. General Statutes 143-291 et seq.

Job functions include investigating claims drafting responsive pleadings conducting discovery and attending all pretrial hearings trials and appellate events. Specifically the attorney must be adept at managing a large caseload reviewing trial transcripts researching applicable law and filing briefs in compliance with the Rules of Appellate Procedure.

Other responsibilities will include client outreach and responding on an as-needed basis to queries from the client agencies regarding negligence and risk management issues speaking at conferences and teaching workshops for individual clients.

This attorney will represent the State before the Court of Appeals and Supreme Court in both Tort Claims actions and criminal actions.If decisions made by the Court of Appeals are appealed the attorney must follow the matter through to final disposition by the Supreme Court.

The salary grade for this position is LG07. State employees are encouraged to apply for positions of interest even if the salary grade is the same as or lower than their current position. Please detail ALL work history including non-state service experience. If selected for this position a new salary will be recalculated taking into consideration the quantity of relevant education and experience funding availability and internal equity. Based upon these factors a pay increase MAY or MAY NOT result.

Minimum Education and Experience Requirements

Licensed to practice law by the North Carolina State Bar and one year of professional legal experience.

NOTE: GS 114-2 and 114-6 make it the duty of the Attorney General of NC to represent the State of North Carolina in all litigation unless another statute specifically states otherwise.
