We have been called on to assist them in identifying a Director,Product Liability and Risk Management to support their local production facilities.

Job Overview

The main mission of the Director, Product Liability and Risk Management be solely responsible for the management of product liability litigation and the management of North America risk matters. Expectations are to be accountable for the following:

• Litigated product liability claims
• Product liability property damage claims
• Risk reduction or mitigation
• Insurance and risk management budget

Job Description

• Oversight of all product liability claims brought against the Company in the US, Canada and Mexico
• Manage the responses to product liability claims, liaising with national and local counsel for product liability litigation, including:
  • Determine defense strategy in product liability claims
  • Determine need and coordinate use of experts
  • Coordinate responses to discovery, liaising internally with company personnel and externally with defense counsel
  • Review all answers to discovery and depositions
  • Responsible for product liability mediations and implementation of related strategies
  • Attend and manage product liability trials with national and local defense counsel
• Coordinate forensic examination of product that is the subject of product liability claims
• Manage Worker's Compensation, Automobile, Marine, Property and other insurance coverage for the US, Canadian and Mexican Companies
• Work with Insurance brokers and carriers to negotiate insurance renewals and ensure best execution claim handling as needed, including:
  • Auto Liability
  • Workers Compensation (including states requiring separate insurance)
  • General Liability
  • Surety bonds for Customs and other matters
• Liaise with insurers, brokers, and Company personnel with respect to new claims and facilitate claim handling and resolution, including cargo theft and loss
• Provide updates to insurers on outstanding litigations
• Assist Global Risk Management in Product Liability Insurance renewals, including management of the data necessary for renewals of global and local coverage
• Collaborate with Legal department on contract and product related activities
• Collaborate with business units in relation to matters with reputational risk exposure
• Work with Quality/Warranty to address tire marking, FMVSS, NHTSA and related issues
• Continuously assess and evaluate claim exposure
• Training of personnel on litigation and other risks
• Act as a representative in industry associations and committees

The Ideal Candidate Profile

• Bachelor Degree and 7-10 years of relevant litigation/claim management experience
• Experience in drafting, monitoring or auditing insurance policies and contracts
• Knowledge of contract laws and principles
• Strong project management, problem solving, multitasking, and facilitation skills
• Experience in negotiations, strongly desired
• Outstanding communication skills
• Strategic and situational leadership and decision-making skills

Periodic travel is required to attend forensic examinations, with additional travel for negotiations, mediations and other proceedings in connection with product liability litigation
