Job Summary

The Execution Contract Manager will be responsible for contract management activities from
project initiation to final project completion balancing customer needs with risk management
from a contractual perspective. This role ensures contract adherence and resolves obstacles
by partnering closely with Legal and cross-functional stakeholders. The Contract Manager
guides execution teams through risk analysis supports financially and operationally and
builds risk management capabilities while driving change.

Duties & Responsibilities:

  • Advises execution Project Managers on complex contracts.
  • Lead reviews at Project Initiation ensuring the assessment of project risks and opportunities exposures liquidated damages contractual milestone dates incoterms and other relevant information.
  • Ensure review at Project Close Out by supporting Project Managers with lien waivers formal letters final settlements and claims.
  • Govern contractual requirements as required by project delivery type including but not limited to EP/EP. For EP experience with the following is required:

Vetting contractors/subcontractors

Developing flowdown contracts for subcontractors/contractors

Implementation of project controls

Management of quality controls

  • Partners with Project Management Procurement Finance and other functional leads to achieve timely resolution of project risks
  • Combine business and team expertise to create innovative contractual solutions to meet business objectives; evaluates and interprets contract compliance and advises others on contractual rights and obligations applying and recommending best practices.
  • Track Liquidated Damages/Penalties owed.
  • Prepare persuasive positions for (and sometimes lead) complex contract negotiations for dispute resolution and change order requests with customers and suppliers
  • Support the development and implementation of risk management processes and controls working with Project Management and leadership
  • Lead claim management including delay analysis prepare claim documentation evaluate time and cost impacts coordinate with technical and legal teams review contractor claims prepare responses and counter-claims and advise management on dispute resolution.
  • Consult with the Legal Team as necessary to support contract negotiations and dispute resolution
  • Provides guidance on contractual terms policies and procedures to project managers and other operational/legal support staff including training on contracting practices and procedures.
  • Ensure compliant performance during the contract life-cycle and implement corrective actions when needed
  • Steer the sharing of best practices and returns on experience in Contract
  • Management to boost possible improvement actions for other contracts.

Hard Skills:

  • Knowledge of legal terminology and concepts as used in commercial contracts
  • Experience with direct customer contact and negotiations to develop and implement risk mitigation plans across their portfolios
  • Experience working in a matrix organisation with multiple stakeholders
  • Ability to provide creative business-oriented advice in a global fast-paced environment 
  • Commercial and execution acumen and understanding of the North American government market and payor dynamics

Soft Skills:

Qualifications :

Education & Experience

  • Degree with strong academic record Legal Business or Engineering
  • 8 years of commercial or transactional legal/contract negotiation experience

 
Required:

  • Must have 10 years of experience in the NORAM Region with a strong understanding and experience of Legal and Contractual terms & Conditions
  • Fluency in English language (French is a plus) and the ability to draft and negotiate in them
  • Experience working with Design-Build (EP or EPC) contractors and contracts

Preferred:

  • General understanding of water treatment technologies and customer industries and operations

Travel estimated at 20% some international travel likely
