Job Summary

THE POSITION:

The Sr. Counsel Global Labor & Employment is a critical strategic role responsible for providing comprehensive legal advice and guidance on a wide range of global labor and employment matters while supporting broader litigation investigations and other legal matters as business needs require. Reporting directly to the Chief Legal Officer this individual will be the primary subject matter expert ensuring the companys compliance with labor and employment laws across all jurisdictions of operation mitigating risk and supporting the companys growth and talent strategies. This is a highly influential individual contributor role requiring exceptional legal acumen business judgment and the ability to operate effectively in a fast-paced global environment.

ESSENTIAL DUTIES AND RESPONSIBILITIES:

EMPLOYMENT LAW:

  • Providesday to day counseling in all areas of state and federal employment law including counseling ondiscipline terminationsanti-discrimination and anti-harassmentdisability law leaves and reductions-in-force.
  • Develops and presents executive-level briefings recommendations and risk assessments to the Chief Legal Officer and others as assigned regarding employment litigation workforce strategy regulatory developments and significant employment-related matters.
  • Provides ex-US legal support for EU UK and APAC region in all material aspects as provided domestically.
  • Provides assistance with GlobalBusiness Conduct cases regarding employee investigations and discipline arising out of violations of company policy.
  • Provides assistance with onboarding of international employees.
  • Creates and delivers employment law-based training programs to management and general employee audiences.
  • Manages litigation arising out of employment law claims and supports other litigation investigations and dispute resolution matters as assigned in partnership with internal and external counsel.
  • Manages statistical analyses for pay equity compensation review variable compensation and reductions-in-force.
  • Advises on use of temporary and contract employees and prepares/negotiates service agreements with temporary labor providers.
  • Addresses all employment law issues in divestitures and acquisition.
  • Advises on employment contracts non-competition agreements confidentiality clauses (in collaboration with Intellectual Property attorneys) and enforcement of the same.
  • Advises on workers compensation cases.
  • Advises on Human Resource workplace policies (drug/alcohol security/workplace violence.
  • Advises on workplace closing staffing reductions redeployments severances issueand required WARN notifications.
  • Advises on HIPAA and state-based privacy issues.
  • Provides legal support for Department of Labor reviews of plans information requests and correction procedures.
  • Demonstrate a commitment to diversity equity and inclusion through continuous development modeling inclusive behaviors and proactively managing bias. 
  • All other duties as assigned.

LABOR LAW:

  • Provides day to day counseling in areas of U.S. labor law.
  • Provides strategic updates and risk assessments to the Chief Legal Officer and others as assigned regarding labor relations matters workforce trends union-related developments and associated business risks.
  • Defends charges under the National Labor Relations Act: unfair labor practices grievances and arbitrations.
  • Provides training for management on union-free workplaces and defense of charges under the National Labor Relations Act.
  • Drafts workplace policies consistent with labor law and protected activities.

EMPLOYEE BENEFITS LAW:

  • Provides day-to-day counsel regarding the administration and interpretation of Eversanas ERISA welfare and tax qualified plans.
  • Provides support to Compensation/Benefits organization and to Treasury organization (when applicable) regarding plan amendments new plan features annuity lift-outsdiscontinuation of benefits and plan terminations.
  • Collaborates on and reviewsall communications to plan participants including year-end election materials.
  • Manages benefits-based litigation and plan appeal process.
  • Drafts reviews and assists in negotiation of administrative services agreements.
  • Advises Company employee service center regarding employee and participant requests.
  • Advises on benefit interpretations and benefits offered in collective bargaining agreements.

EXPECTATIONS OF THE JOB:

  • Travel (Minimal maximum of two multi-day summits per calendar year)
  • Hours (40 hours Monday through Friday)

Qualifications :

MINIMUM KNOWLEDGE SKILLS AND ABILITIES:

The requirements listed below are representative of the experience education knowledge skill and/or abilities required.

  • Juris Doctor from accredited law school
  • Bar admission
  • 10-12 years of relevant law firm and/or corporate law department experience
  • Global L&E Experience with APAC EU and UK
  • Collaborative style accustomed to working on teams excellent communication presentation and writing skillspragmaticapproach and problem-solving skills with demonstrated ability to influence organizational outcomes through strategic legal counsel.

PREFERRED QUALIFICATIONS:

  • Health privacy law expertise (HIPAA marketing GDPR sensitive personal data/health data transfers etc.)  preferred
  • Prior in-house experience
  • Prior employment litigation experience required; broader litigation investigations or dispute resolution experience preferred.

Office: While performing the essential functions of this job the employee is frequently required to reach grasp stand and/or sit for long periods of time (up to 90% of the shift) walk talk and hear; occasionally required to lift and/or move up to 25 pounds. The noise level in the work environment is usually moderately quiet with frequent interruptions and multiple demands.

EVERSANA is committed to providing competitive salaries and benefits for all employees. The anticipated base salary range for this position is $8400 to $117000 and is not applicable to locations outside of the U.S.  The base salary range represents the low and high end of the salary range for this position.  Compensation will be determined based on relevant experience other job-related qualifications/skills and geographic location (to account for comparative cost of living).  EVERSANA reserves the right to modify this base salary range at any time.
