Job Description:

Assists the Chief Program Counsel in providing legal advice guidance to foundation executives leaders management and staff on all legal matters of the foundation including but not limited to contracts corporate and governance matters private operating foundation tax requirements applicable licensing accreditation and regulatory issues intellectual property real estate insurance privacy and information security employment issues and litigation. Assists the Chief Program Counsel in staying abreast of and in compliance with applicable laws and with general organizational risk management. Partners with programmatic work units to provide advice and counsel on programmatic issues including child and family matters and other partnerships and collaborations in furtherance of Caseys mission.

Essential Responsibilities:

  • Provide strategic counsel and advise internal clients including foundation executives leaders management and staff regarding a variety of issues related to legal compliance and risk management for the foundations business and operations including but not limited to privacy information security and artificial intelligence direct services to children youth and families licensing and accreditation issues applicable employment laws and issues nationwide insurance issues and risks in contracting disputes and litigation matters.
  • Provide legal counsel in areas of expertise and advise on a range of programmatic issues related to the foundations direct services and support to children youth and families engagement with partners and constituents research efforts and consulting.
  • Partner with and oversee as well as serve as back-up for the foundations Privacy Officer with respect to applicability of Health Information Portability Privacy Act (HIPAA) and other applicable privacy laws data breach state and federal laws emerging laws relating to artificial intelligence and related legal and ethical obligations to clients and former clients. Partner closely with Privacy Officer and Security Officer on foundations Information Security Program and privacy program including developing and implementing policies procedures and trainings serving on the Incident Response Team participating in internal security audits as well as responding to external privacy and security audits participating in the foundations governance and oversight of the use of artificial intelligence advising on development of tools and systems and reviewing contractual terms on data protection privacy and confidentiality and artificial intelligence.
  • Oversee organizational policies and procedures related to records records management and records retention. Oversee all records requests including former client record requests as well as third party subpoenas. Evaluate records requests including former clients and other third-party requests and provide counsel.
  • Oversee the organizations robust insurance portfolio to ensure proper programmatic and operational risk management including managing the relationship with the insurance broker and assisting the Chief Program Counsel in making recommendations to the Board of Trustees annually on insurance coverage and risk management program.
  • Manage all of the foundations litigation and legal disputes including reviewing evaluating and responding to lawsuits governmental investigations demands and subpoenas; engaging and managing outside counsel as needed; and preparing legal briefings for the Executive Team and Board of Trustees.
  • Partner with and oversee Senior Director/employment counsel on employment matters including reviewing and revising policies to stay current with evolving laws providing legal advice and counsel on employment matters including accommodation issues directing attorney-client privileged investigations when needed providing counsel to HR on employee investigations and partnering on management of employee conflicts of interest.
  • Ensure compliance with applicable local state and federal laws as well as internal policies and procedures including but not limited to best employment policies and practices foster care licensing and accreditation requirements protection of human subjects and privacy. Oversee and manage the Council on Accreditations reaccreditation process which occurs every four years.
  • Supervise and manage the legal departments Senior Director Program Counsel Privacy and Senior Director Program Counsel - Employment.
  • Closely partner with the other Managing Director in Legal Services to assist Chief Program Counsel with team operations and management work efforts and planning work assignments and special projects.
  • Perform legal analysis and develop policies procedures and guidelines on a variety of legal topics related to foundations programs as requested by the Chief Program.
  • Develop and provide training and educational programs on legal requirements to foundation leaders management and staff.
  • Other duties as assigned.

Qualifications:

  • Law Degree with a minimum of fifteen years broad-based experience in the private public or non-profit sector is required. At least five years supervisory experience is required. Knowledge of and responsible experience with employment laws litigation and privacy and security laws and risk management is critical. A working knowledge of pertinent laws and regulations related to children youth and families is expected. Knowledge about competence in and familiarity with the infrastructures of child welfare systems the legal and legislative aspects of child protection long and short-term foster care adoption and guardianship and legal requirements related to grants are highly desired. A Privacy Certification through the International Association of Privacy Professionals (IAPP) such as CIPP/US and CIPM is highly desired and preferred.
  • The essential professional qualifications include excellent organizational ability analytical strategic thinking and significant business acumen; clear and concise oral and written communication skills; avid attention to detail as well as the ability to identify and resolve issues proactively creatively and expeditiously.
  • A balance of assertiveness and diplomacy is important as well as leadership skills and the ability to collaborate effectively with a team of professionals internal and external to CFP. Must be able to work well both independently and as part of a team to manage multiple priorities efficiently and to maintain self-control while under pressure or while in stressful Proven effectiveness and ease in a multi-cultural environment are highly desired.
  • This is a regular full-time position that may require travel up to 20% of the time.
  • Ability to protect the confidentiality of sensitive information by learning and following all relevant policies and protocols and using sound judgment in the handling and sharing of that information.
  • Ability to perform effectively in high pressure and stressful work environment. Ability to manage stress and self-care.
  • Ability to work onsite full-time to meet the collaborative responsibilities that are essential for this position. Regular and reliable attendance is required.
  • Physical requirements include the ability to lift and reach for light objects; ability to type and work at a computer for extended periods of time as a primary job function.
  • Local travel as well as occasional out of town travel may be Driving on Casey business may require use of personal vehicle; adherence to vehicle safety guidelines and qualification for insurance is require.

The typical hiring range for this position in Seattle WA is $210290 to $247400. The full salary range for the role is $210290 to $284510. Casey Family Programs offers comprehensive benefits including medical dental and vision coverage accrual of 12 days of annual leave 12 days of sick leave10 paid holidays per year and each employee receives one personal holiday to use each calendar year. Employees that meet certain tenure qualifiers are eligible for up to eight weeks of parental leave for the birth or placement of a child for adoption or foster care. After the completion of 10 years of continuous full-time regular employment employees in good standing are permitted for a three-month sabbatical with pay.
