We pursue claims with tenacity and legal rigor and we are now building a class action practice to address systemic overcharges affecting multiple customers. We seek an exceptional Consumer Class Action Attorney to lead this strategic expansion.
For over 35 years UtiliSave has led the utility bill auditing industry and we are still growing. Our legal team is evolving to include class action litigation expertise. We are seeking a Consumer Class Action Attorney with 7 years of plaintiff-side class action experience to develop and lead consumer class action cases arising from utility billing disputes regulatory non-compliance and systemic overcharges. This role offers the rare opportunity to build a novel litigation practice at a mission-driven company with the resources to pursue cases aggressively.

Our clients include manufacturers hospitals nursing homes commercial and residential buildings universities hotels religious institutions and government facilities. Across these sectors we routinely uncover evidence of systemic utility overcharges billing errors and regulatory violations. We believe many of these claims warrant class action treatment. You will develop case theories vet claims pursue discovery negotiate settlements and represent classes in litigation. This is an opportunity to leverage your consumer class action expertise in a new domainutility cost recoverywith significant upside and genuine potential to recover substantial damages on behalf of injured consumers.
You will own UtiliSaves consumer class action practice from the ground up. This role is foundational to a major strategic initiative. You will identify cases with class certification potential develop litigation strategy manage discovery negotiate with defendants and co-counsel and ensure all matters comply with CAFA and applicable state class action rules. You will work directly with executive leadership to evaluate new cases and allocate resources. As we scale the practice toward multiple active cases your role will expand with associate and paralegal support added as demand grows.

Identify evaluate and vet consumer class action opportunities arising from utility billing disputes rate design violations regulatory non-compliance and systemic overcharges.
Develop case theories substantive claims and litigation strategies; assess class certification likelihood damages potential and settlement value.
Draft pleadings motions discovery requests and other litigation documents with precision and strategic acuity.
Manage discovery process; produce documents respond to interrogatories and conduct/defend depositions.
Negotiate with defendants opposing counsel and co-counsel on settlement terms; structure class-wide recovery and administration.
Represent UtiliSave and class members at hearings depositions mediation and trial.
Develop novel applications of consumer protection law and class action doctrine to utility billing and cost recovery disputes.
Coordinate with outside counsel when appropriate; manage relationships with expert witnesses claims administrators and co-counsel.
Advise executive team on litigation strategy risk allocation and case portfolio decisions.
Work collaboratively with audit team to translate audit findings into class action claims and evidence packages.
Licensed to practice law in at least one U.S. jurisdiction (multi-state license preferred).
Minimum 7 years of experience in consumer class action litigation with substantial plaintiff-side experience preferred.
Demonstrated expertise in class action law including class certification CAFA jurisdiction discovery management and settlement negotiation.
Strong substantive knowledge of consumer protection statutes (FCRA FDCPA TCPA state consumer protection acts etc.).
Proven success developing novel legal theories and pursuing cases in emerging or complex legal domains.
Exceptional legal research writing and oral advocacy; clear persuasive communication in briefs presentations and depositions.
Strategic thinker who can assess case portfolio prioritize resources and make data-informed litigation decisions.
Strong negotiation and settlement skills; ability to drive favorable outcomes for class members while maintaining ethical boundaries.
Comfort building and working collaboratively with outside counsel and expert consultants.
Self-starter with entrepreneurial mindset; able to operate independently while building practice infrastructure.
Willingness to learn domain-specific knowledge about utility billing tariff structures regulatory frameworks and cost recovery.
Proficiency with litigation management platforms legal research tools (Westlaw LexisNexis) and document management systems.
