Duties

The advertised salary reflects the minimum and maximum pay for the locations listed. Upon selection the salary will be set in accordance with the selectees assigned duty location.

The Associate Regional Director provides expertise advice and recommendations to the Regional Director to assess the fiduciary conduct of plan officials and service providers; determine the appropriateness of plan administration plan financial activities and investments; evaluate compliance with ERISA and related Federal laws.

Duties include but are not limited to the following:

  • Plan and assign work based on employees skills and workload evaluate employee performance set performance standards and identify training and development needs.
  • Analyze technical issues and review enforcement work products to assess legal sufficiency ensure consistent interpretation and verify technical quality and compliance with policy legal precedent and the impact of decisions.
  • Oversee the regional Benefits Advisors unit to ensure inquiries are handled timely and according to SOPs and regional procedures.
  • Analyze new complex or precedential issues involving plan administration financial activities investments and fiduciary conduct while providing expert guidance to investigators and staff on applying ERISA and related laws regulations and court or policy developments.

Qualifications

You must meet the Specialized Experience to qualify for the Associate Regional Director as described below.

For GS-14: Applicants must have 52 weeks of specialized experience equivalent to at least the next lower grade level GS-13 in the Federal Service.

Specialized Experience is the experience that equipped the applicant with the particular knowledge skills and abilities (KSAs) to perform the duties of the position successfully and that is typically in or related to the position to be filled. To be creditable specialized experience must have been equivalent to at least the next lower grade level.

Applicants must meet 3 out of the 4 examples of specialized experience below.

Examples of qualifying specialized experience are:

1) Experience planning directing or leading technical civil and/or criminal employee benefits investigations as well as compliance and participant assistance activities involving ERISA-covered plans including analysis of fiduciary conduct plan administration plan financial activities and investments and developing investigative strategies where precedent may be limited.

2) Experience providing technical guidance and review of enforcement outreach and participant-focused work products for legal sufficiency and compliance with ERISA applicable regulations/exemptions agency policy and relevant legal precedent including identifying issues and recommending appropriate courses of action to management.

3) Experience developing implementing and evaluating employee benefits program initiatives (e.g. regional enforcement projects training programs outreach/education events voluntary correction or abandoned plan-related efforts) using performance measures/metrics to assess effectiveness and recommend improvements.

4) Experience coordinating and representing an organization with internal and external stakeholders (e.g. SOL DOJ/U.S. Attorneys IRS SEC state agencies plan officials and their representatives) to communicate policy/legal positions resolve issues of mutual concern and support case development compliance or litigation activities.

Education

There is no substitution of education for the required specialized experience for this position at the GS-14 level.

BACKGROUND INVESTIGATION

You may not be aware but in the regulations for agency ethics programs there are requirements for supervisors. Section 2638.103 of Title 5 of the CFR states: Every supervisor in the executive branch has a heightened personal responsibility for advancing government ethics. It is imperative that supervisors serve as models of ethical behavior for subordinates. Supervisors have a responsibility to help ensure that subordinates are aware of their ethical obligations under the Standards of Conduct and that subordinates know how to contact agency ethics officials. Therefore if selected you will be required to complete a Confidential Financial Disclosure Report (OGE Form 450) to determine if a conflict or an appearance of a conflict exists between your financial interest(s) and your prospective position with DOL. This information will be required annually.
