Chief Compliance Officer Asia Segment
Job Summary
Responsibility:
Responsible for the overall leadership of the 2nd line of defense compliance function in Asia including but not limited to anti-money laundering and anti-terrorist financing sanctions compliance fraud prevention privacy distribution compliance (including 2nd line oversight of distributor conduct cross border sales compliance and OSFI Guideline B-10 requirements as they apply to distributors) customer fair dealing marketing material reviews compliance training and the Asia Segment implementation of Manulifes legislative and regulatory compliance management program. This includes:
Providing leadership and direction to Market Business Unit Compliance Officers.
Managing external relations with regulators and industry associations.
Leading and managing oversight of Asia Segment Markets to ensure that Regulatory risks are appropriately managed and that effective regulatory compliance management controls and process are in place to comply with local regulatory requirements and global standards. This includes ensuring that the Compliance function is able to provide timely accurate relevant and risk-based advice to 1st line control owners.
Escalating and reporting significant compliance issues to Manulife Financial Asia Limiteds (MFAL) Board and providing information required for the board to assess the adequacy of the regulatory risk management program in Asia Segment. The Asia Chief Compliance Officer (Asia CCO) has unfettered access to full and complete information throughout Asia Segment and may communicate directly with MFAL Board as appropriate either through presentations at scheduled board meetings or as required and at the Asia Segment Chief Compliance Officers sole discretion.
Providing advice and guidance to Asia Segment senior management on compliance regulatory risk ethics conflict of interest and reputational risk.
Championing and assisting Asia Segment senior leadership to foster a culture of compliance and ethical business conduct across Asia Segment.
Ensuring that quarterly reporting is provided to the President Asia Segment Asia Segment Leadership team and the Global Chief Compliance Officer and that significant compliance issues are escalated to senior management in a timely manner. Also ensuring that Asia Segments compliance issues are recorded in Manulifes Governance Risk and Compliance tool for documentation remediation and tracking purposes.
Overseeing the development and execution of Segment and Market-level 2nd line control testing programs to provide reasonable risk-based assurance that the 1st line has implemented suitable controls to address critical compliance risks and that those controls are operating addition provides support to the RCM program.
Overseeing or directing the review design and implementation of enhancements to the compliance program to address deficiencies arising from regulatory reviews audits testing and self-assessments or to increase the overall effectiveness and efficiency of the compliance function in Asia Segment.
Within the context of a centrally managed global budget managing Regional Compliance budgets regional projects as well as ensuring adequate staff levels are maintained and sufficient resources are available.
Responsible for talent management within the Asia Segment Compliance function including the development of current staff and ensuring that Asia Segment markets and the Regional Compliance organization have strategies in place to attract and retain appropriate compliance personnel.
Sits on a number of Segment steering committees and working groups currently including the Asia Risk Committee the Distribution and Sales Risk Committee the Asia Compensation Steering Committee the Asia Information Risk Management Committee and the Emerging Markets Risk Review Committee.2
Oversees and coordinates compliance activities for the Global Retirement business in Asia primarily with a view to ensuring better overall coordination between the LifeCo and GWAM compliance and to coordinate and resolve any differences (e.g. of opinions) between the Asia Segment (Life Company) and Global Wealth and Asset Management Compliance teams; and ensure appropriate upward escalation of issues and risks.
As a member of the Global Senior Compliance Leadership Team participates in company-wide compliance initiatives. Represent Compliance globally and leads cross-divisional compliance initiatives and strategies to deal with issues that impact the entire company.
Job Requirements (Education Experience Knowledge Skills and Competencies):
Independent mindset consistent with OSFIs expectations that the compliance function will have and demonstrate the authority to carry out its functions independently.
Significant (15 years) of relevant compliance and leadership experience ideally including one or more Asian markets
Language skills (e.g. Mandarin Cantonese Japanese Bahasa) a definite advantage.
Experience in executing large-scale compliance technology and automation projects.
Solid understanding of AI and automation trends in Compliance and ability to manage to scale and efficiency.
Significant experience in managing large and complex compliance functions within financial institutions.
Strong people leadership skills and the ability to build and lead successful teams.
Excellent oral and written communication skills and the ability to communicate and influence at all levels of the organization including senior management.
Recognized as a senior decision-maker on very complex compliance issues and projects.
Understanding of regulatory requirements and compliance issues that arise in various lines of business within the financial services industry (e.g. life insurance wealth management securities group benefits and retirement savings banking).
Ability to manage a large number of relationships with senior managers and to manage the inherent conflicts that can exist between compliance and business objectives.
Job Scope (Dimensions & Organizational Impact):
Asia Segment: Extensive collaboration with Global Asset Management business in Asia particularly in the areas of sanctions compliance AML/ATF & the Retirement business.
1 Matrix reporting in Indonesia and Mainland China due to regulatory requirements and direct reporting in all other markets.
2 Specific committee memberships and the names of those committees will change over some cases and if permitted by the Committees mandate the Asia Chief Compliance Officer may assign a delegate to attend certain committees.
