In meeting this mission Attorney General Kathy Jennings is supported by teams of talented lawyers and staff in the Criminal Civil Family Fraud and Consumer Protection and Civil Rights and Public Trust Divisions. Each of the more than 500 staff who work in the Office of the Attorney General are dedicated to serving all Delawareans with integrity and passion.

Deputy Attorneys General with critical support from criminal special investigators victim service specialists paraprofessionals and administrative staff prosecute criminal cases enforce consumer laws provide counsel to state agencies ensure the publics access to open government protect the abused and much more.

Summary Statement

The Delaware Department of Justice is looking for an exceptional attorneyand leader to head the Consumer Protection Unit (CPU) one of DOJs mostvisible and public facing units as its next Director. The CPU Director leads atalented team of attorneys investigators paralegals and staff who show upevery day to protect Delawareans from deceptive and unfair practices by thosewho would exploit them. You willinvestigate and litigate major cases (both local and national in scope) shapeenforcement priorities alongside the Attorney General craft the legislativepriorities to bring before the General Assembly and innovate creative andstrategic ways to make Delaware a safer place for consumers.

The Consumer Protection Unit serves as a critical safeguard toprotect Delawareans from unfair deceptive and illegal practices in themarketplace through enforcement mediation advocacy educationregistration and outreach. CPU has enforcement authority over more than 40different state and federal laws with a focus on the Consumer Fraud Act andthe Deceptive Trade Practices Act. CPU prosecutes civil andadministrative cases and also conducts multistate investigations incoordination with other states attorney general offices.

Essential Functions

The Director is responsible for strategicallyleading managing and directing all functions of CPU a statewide unitconsisting of Deputy Attorneys General paralegals special investigators atechnologist and administrative staff. This is a significant leadershipopportunity within the Department of Justice that offers an opportunity to workclosely with DOJ senior leadership on major policy priorities for the AttorneyGeneral and help shape the consumer protection landscape in Delaware.

The Director oversees CPUs broadportfolio enforcing more than three dozen civil consumer laws and regulationsin a variety of subject matters including consumer fraud deceptive tradepractices antitrust privacy data security charitable solicitationsmanufactured housing debt management health spa and telemarketing. CPUbrings major enforcement actions in state and federal court against companiesengaged in deceptive practices as well as administrative prosecutions andenforcement of cease-and-desist orders issued by the Director.

The Director is responsible forthe performance culture and strategic direction of CPU. The Director must bean effective manager of people an experienced legal professional a crediblepublic voice on consumer protection issues and a strategic partner to theAttorney General and her leadership team on enforcement priorities legislativematters and intergovernmental coordination.As Director you will report directly to the Division Director and serveas a strategic partner to the Attorney General and her leadership team. Yourresponsibilities will fall into four interconnected areas:

Enforcement

  • Oversee all local and national consumer protection enforcement through investigative and prosecution phases while maintaining an active personal caseload
  • Approve and direct major investigations; determine when to escalate to formal proceedings; authorize and lead consumer protection litigation
  • Ensure that complaint patterns surfaced through mediation are appropriately escalated to enforcement review
  • Coordinate with multistate enforcement coalitions including NAAG task forces and with federal partners

Management

  • Lead a statewide unit of Deputy Attorneys General paralegals special investigators a technologist and administrative staff
  • Work closely with the Chief Special Investigator and Assistant Unit Head on legal administrative and HR matters
  • Set performance expectations conduct evaluations and drive accountability across the Unit
  • Manage hiring performance management and employee relations in collaboration with Human Resources
  • Oversee the Consumer Protection Fund
  • Build and sustain a Unit culture that is professional mission-driven equitable and responsive

Policy

  • Serve as DOJs primary liaison to the Delaware General Assembly on consumer protection legislation
  • Advise the Attorney General on legislative priorities and provide testimony before legislative committees
  • Ensure that enforcement priorities align with the Attorney Generals consumer protection agenda and DOJs strategic priorities
  • Alert executive leadership to emerging issues and trends

Communications & Outreach

  • Draft and review press releases public statements and consumer publications
  • Handle and assign media inquiries public speaking requests and consumer education initiatives

The Director also performs relatedduties and responsibilities as assigned.

Deputy Attorneys General in CPUincluding the Directorare responsible for all phases of litigation andother enforcement actions including working with special investigatorsdrafting and filing pleadings conducting discovery negotiating settlementsand trying cases in all Delaware courts before juries judges and administrativehearing officers. CPU DAGs also provide consumer education to the publicand work with other state and governmental agencies to address consumerprotection issues.
