JOB PURPOSE:

Conducts timely and consistent investigations - independently or as part of a team - under the provisions of The Law Society Act addressing matters related to (i) the professional conduct of Licensees (ii) the unauthorized provision of legal services by individuals not licensed and (iii) the good character of Licensee applicants. Develops disposition proposals aligned with the Law Societys public interest mandate legislation by-laws and policies. Coordinates with Litigation Services staff and provides testimony in regulatory and court proceedings when files do not reach settlement or involve disciplinary action. Manages investigation files that may involve politically or media-sensitive matters subject to public scrutiny.

QUALIFICATIONS REQUIRED:

  • Requires completion of a 2-year college program or a university degree in Legal Studies Policing Criminology Social Work Social Sciences or a related discipline. Equivalent legal and/or accounting training and/or investigative experience will be considered.
  • Requires a minimum of 5 years of experience independently managing investigation files preferably in a law office or accounting environment.
  • Investigation experience derived from work in law enforcement in a legal government and/or regulatory environment is preferred.
  • Professional Knowledge:
    • The Law Societys mandate services legislation and policies would be an advantage.
    • Interview and investigation methodologies principles and practices.
    • Current trends and developments in investigative techniques.
    • Experience in testifying.
    • Law Society accounting and bookkeeping knowledge is preferred.
    • Dispute resolution techniques.
  • Technical Skills:
    • Microsoft Office Suite / 365 (Word Excel PowerPoint etc.).
    • Broad understanding of the application of technology in a legal / regulatory environment.
    • Familiarity with Microsoft One Drive and SharePoint and Adobe Pro are assets.
    • Accounting software (general trust).
    • Internet search capabilities.

    • Project coordination prioritization and time management skills.
    • Interpersonal and oral communication skills to facilitate the resolution and disposition of complaints.

    • Concise well organized writing skills in the preparation of a full range of investigative documents and memoranda which may form the basis for disclosure to Discipline Counsel and agreed statement of fact.

KEY ACCOUNTABILITIES

Investigations & Case Management

  • Investigates serious matters including professional misconduct (including sexual misconduct) criminal allegations conduct unbecoming competence concerns licensing issues capacity matters and unauthorized practice.
  • Prepares case plans determines investigation strategies identifies required evidence and independently conducts investigations in accordance with case plans. Identifies risk and performs ongoing analysis.
  • Assesses the need for and recommends appropriate responses such as establishing practice controls obtaining search and seizure orders identifying potential candidates for remedial diversion and seeking opportunities for alternative dispute resolution mechanisms.
  • Devises and implements supervision plans relating to members practices.
  • Communicates with staff complainants and licensees regarding investigation processes and case dispositions while maintaining strict confidentiality of sensitive information at all times.
  • Gathers evidence by conducting interviews with licensees witnesses complainants and other relevant sources performing searches and seizures and documenting all material evidence using case management software in accordance with procedural and evidentiary requirements.
  • Develops case files to prosecutorial and evidentiary standards including Investigation Reports and Investigator Key Documents.
  • Monitors Licensees who are facing criminal charges involved in legal or tribunal proceedings (other proceedings) or subject to investigations or actions by other regulatory bodies.
  • Assists Litigation Services staff in preparing cases for hearings and testifies as a witness in legal and regulatory proceedings as required.

Team Membership

  • Facilitates the sharing and transfer of knowledge and information within the department and division to enhance team capability and consistency.
  • Contributes to the development of standardized practices guidelines and procedures for the proper conduct and resolution of investigation files.
  • Manages own caseload while collaborating with team members in the department Intake and Resolution and Litigation Services to establish monitor and continuously improve processes and case management performance metrics.
  • Continuously reviews policies and procedures identifies opportunities for enhancement and participates in the development and implementation of assigned policy initiatives related to investigative activities.

Relationship & Alliance Building

  • Develops and maintains mutually beneficial relationships with law enforcement government agencies federal and provincial judicial bodies and financial institutions to facilitate effective information sharing and collaboration.

WORKING ARRANGEMENT

The Law Society has introduced a Distributed Workforce Model to leverage flexibility and agility and to maximize employee productivity and engagement. Work arrangements will be determined by role and departmental requirements. The working arrangement for this position has been classified as primarily remote with a requirement to attend the office on an occasional basis.
