Job Summary
An opportunity has arisen for a Legal Advisor accountable for taking the day-to-day legal responsibilities and providing legal advice that includes all the aspects of the analysis investigation and drafting correspondence associated with potential claims litigation and disputes procedures. He/she is responsible for providing support in discrete legal issues by advising the organization drafting undertakings and structuring remedies for the relevant issues.
Duties & Responsibilities
Litigation and Disputes
- Advising on appropriate action in variety of legal matters including labour disputes alternative dispute resolutions and arbitration commercial and / or civil litigation and criminal actions recoveries road trafficaccidents and incidents and insurance related legal matters.
- Preparing correspondence and legal documents such as contracts pleadings briefs affidavits motions and settlement agreements for contract negotiations and proceedings.
- Manage and assist with any litigation mediation and/or arbitration emanating from transactions identify new and amendments to legislation that impact Unitrans and advise and assist with implementation thereof.
- Case and matter management of all company
- Oversight and management of debt and claim recoveries escalated to the legal department.
- Availability after-hours in the event of urgent matters and assistance to operational teams.
- Co-ordinating legal matters requiring external legal assistance which includes managing legal instructions and panel of attorneys and making appearance in court with counsel if required.
- Presentations to client/s and/or Unitrans committee/s on litigation and recoveries matters.
- Assist with management of litigation budget and fees.
Commercial Legal
- Draft vet negotiate and interpret commercial agreements legal correspondence and memoranda within defined timelines.
- Review external commercial agreements and other legal documents received from third parties to advise internal stakeholders on the acceptability thereof and to align it with Group policies.
- Identify manage and advise on legal and contractual risk.
- Draft risk summaries to highlight risks in agreements.
- Assist with tenders for different divisions.
- Assist with contract lifecycle management including timeous signing of agreements following up on status of agreements timeous renewal of agreements etc.
General
- Interact with Executive Committee various subsidiaries business units and external stakeholders on legal related matters with a specific focus on claims disputes and other litigious matters.
- Provide strategic and practical legal advice and support to various business units to assist their operational teams to strategically deal with legal challenges within their operations.
- Independently conduct and attend to legal research on complex matters and prepare concise legal opinions for consideration and implementation by the operational teams
- Advise Debtors department in respect of corporate/commercial litigation and recoveries matters..
- Keep abreast with new legislative and industry developments to provide general legal advice and support to various business units.
- Maintaining professional competence through continuous professional development and maintaining relevant training records which satisfy the current regulations and requirements.
- Assist with the appointment process of procuring external counsel on the panel attorneys. provide the requisite instructions to appointed external counsel.
- Ad hoc general legal matters which may from time to time arise including assisting property matters company secretarial and other ancillary matters.
- Compile monthly quarterly and annual reports on litigious matters..
- Assist with preparation and internal audit and reviews from time to time with a particular focus on the litigation and disputes.
- Assist with legal review and updates of company policies together with the Governance Finance Risk and Compliance or other departmental projects.
- Support initiatives aimed to achieve personal and team targets audit and quality requirements service level agreements (SLA) and key performance indicators (KPI).
- Contribute to the development of investment litigation strategy for Unitrans including assisting in the design delivery and implementation of system changes workflow and process improvements.
- Undertaking other duties of a reasonable nature which may be requested from time to time.
Minimum Requirements
Qualification and Experience:
- LLB / B. Proc degree
- Admission as an attorney /advocate
- Up to 2 years experience in the same or similar role
- Experience with POPIA Data Processing Agreements and supplier and procurement agreements is advantageous
Competencies and Skills:
- General litigation experience
- Dispute resolution experience
- Corporate/ Commercial Law experience (Supply and Procurement Insurance freight forwarding and clearing and/or logistics and transport industry exposure advantageous).
- Excellent drafting skills with a focus on pleadings and motions summons proceedings labour related agreements (including settlement agreements and mutual separation agreements) and general commercial agreements (including NDAs Supply agreements Data Protection Agreements)

- Computer literacy with proficient skills in Microsoft Office Suite
- Prior experience with Legal Matter Management Systems or Practice Management Software beneficial
