    Education/Experience

    Required:

    • Juris Doctorate Degree from an accredited law school
    • Colorado Law License by the Colorado Supreme Court as an active attorney
    • Valid Colorado Drivers license

    Preferred:

    • Advanced knowledge of education law (Federal and State)
    • Minimum of five years experience preferably in K-12 school law and/or working in a law firm representing school district clients

    JOB DESCRIPTION

    Summary/Objective: The legal counsel must possess special knowledge of constitutional law and Colorado school law knowledge of Colorado statutes pertaining to schools and knowledge of the regulatory powers limitations authorities and responsibilities of the Board of Education. To fulfill these responsibilities the attorney must have a working knowledge of the Greeley-Evans School District 6 and the educational philosophy and policies of the Board of Education. Additional responsibility includes advisement of district administrators superintendent superintendents cabinet and Board of Education. Provide representation in court and other administrative processes including truancy cases expulsion hearings Office for Civil Rights reviews and complaints subpoenas etc. Regular in-person attendance as well as some evening and weekend events are required.

    Essential Functions:

    School-Based: Counsel administrators in all matters relating to students rights responsibilities and discipline. Investigate and research areas of district operations to assist administrators in making legally defensible decisions. Provide legal training to the District Leadership Team and other staff on new and revised laws court cases district policies and other compliance matters. Collaborate with the compliance officer and human resources on related investigations.

    Advisement: Advise the Board of Education superintendent and superintendents cabinet regarding emerging legal matters. Participate as a member of the Superintendents Cabinet. Review contracts and intergovernmental agreements to be signed by the superintendent Board of Education and other administrators. Review revise and draft proposed policies regulations and exhibits. Attend school board meetings and executive sessions. Advise the Board of Education on legal matters and parliamentary procedures. Work with the Communications Department to review and edit statements to school communities and assist with responses to public records requests. Review pending legislation. Provide legal guidance to the human resources department and risk management department. Represent the district in grievance arbitration hearings.

    Outside Legal Counsel: Supervise coordinate assign and monitor tasks performed by outside legal counsel. Respond orally and through written memoranda to questions about application of district policies and procedures to situations at all levels of operation. Coordinate with district insurance carriers on legal issues and insurance coverage.

    Special Education: Advise Special Education Department in all related legal matters utilizing specialized knowledge. Attend IEP-related meetings if a familys lawyer is involved. Represent the District in special education administrative complaints and investigation conducted by outside parties.

    Policy Procedures Contracts Etc.: Draft or coordinate drafting of legal documents including contracts negotiated agreements and position statements. Prepare a wide variety of written materials for the purpose of documenting activities providing written references conveying information and/or supporting presentations concerning policy and procedure changes. Anticipate potential litigation and administrative claims gather necessary information perform investigations and align resources. Represent the district in all stages of legal proceedings with the exception of court cases including labor grievances civil rights complaints appeals to the Board of Education curriculum challenges and State Board of Education matters. Draft review and edit and maintain district policies after consulting with district leaders CASB and appropriate personnel. Draft review and edit handbooks release and waiver forms and other documents to help protect the district and employees from liability. Oversee the implementation of Title IX policies and procedures.

    Other Functions:

    • Advanced interpersonal relations and written and oral communication skills.
    • Intermediate ability to perform legal research on Internet and legal websites.
    • Strong word processing microcomputer and Internet skills.
    • Ability to maintain confidentiality in all aspects of the job.
    • Ability to promote maintain and follow Board of Education policies Superintendent procedures building and department procedures.
    • Ability to communicate interact and work effectively and cooperatively with all people including those from diverse ethnic and educational backgrounds. Willingness to contribute to cultural diversity for educational enrichment.
    • Ability to recognize the importance of safety in the workplace follow safety rules practice safe work habits utilize appropriate safety equipment and report unsafe conditions to the appropriate administrator.
    • Ability to practice and lead a shared-decision problem-solving approach.
