Description of Job

TheColorado Lotterys mission is to maximize the proceeds from Lottery game sales to support the Lotterys beneficiaries for the good of all Coloradans.

The Criminal Investigator V (Agent-In-Charge) provides leadership oversight and subject-matter expertise for criminal compliance and background investigations within the Colorado Lottery. This position is responsible for managing investigative operations supervising both sworn investigators and non-sworn investigators and ensuring the integrity security and regulatory compliance of Lottery operations statewide.

A typical day as a Criminal Investigator V in the Lottery Division:
The Agent-In-Charge oversees criminal and administrative investigations involving Lottery employees retailers vendors and associated partners; conducts and reviews complex background investigations and serves as the Lotterys lead authority on physical security systems and incident response. This role exercises independent judgment in enforcement decisions policy development and risk mitigation and regularly collaborates with internal leadership prosecutors law enforcement agencies and regulatory partners.

This position functions as a supervisory officer maintains POST certification and represent the Lottery in hearings proceeding and before the Lottery Commission as assigned.

Primary Job Duties:

Supervision and Management Investigations

  • Provides direct supervision and leadership for criminal compliance and background investigations including workload management task assignments and operational oversight.
  • Establishes performance expectations conducts evaluations and develops performance improvement plans consistent with state personnel rules and departmental policy.
  • Reviews and investigative work products for accuracy completeness legal sufficiency and adherence to best practices and statutory requirements.
  • Develops implements and updates investigative policies procedures and operation guidelines for Criminal and Compliance investigative teams.
  • Recommends hiring promotion disciplinary action and corrective measures of investigative staff in coordination with leadership and Human Resources.
  • Coordinates with prosecutors law enforcement agencies and regulatory partners regarding criminal charges plea agreements and case disposition.
  • Conducts integrity operations undercover activities and underage sales stings to ensure regulatory compliance.
  • Maintains POST certification and required law enforcement training to remain in good standing as a sworn peace officer.

Criminal Investigations and Enforcement

  • Conducts and oversees criminal investigations involving alleged violations of Colorado Revised Statutes and Lottery Rules by employees retailers vendors and associated individuals.
  • Collects analyzes and preserves evidence; interviews subjects and witnesses; prepares reports affidavits and case documentation; and testifies in hearings trials or administrative proceedings as required.
  • Determines appropriate investigative methods and enforcement actions based on severity legal standards risk and public interest.
  • Coordinates with prosecutors law enforcement agencies and regulatory partners regarding criminal charges plea agreements and case disposition.
  • Conducts integrity operations undercover activities and underage sales stings to ensure regulatory compliance.
  • Maintains POST certification and required law enforcement training to remain in good standing as a sworn peace officer.

Background Investigations

  • Plans coordinates and conducts complex background investigations involving Lottery employees vendors retailers and contractor personnel.
  • Evaluates criminal history financial records tax information civil litigation conflicts of interest disclosures and indicators of fraud or misrepresentation.
  • Reviews fingerprint results and resolves rejected or complex fingerprint submissions with state and federal agencies.
  • Prepares detailed investigative reports documenting findings risk assessments and recommendations related to suitability and access determinations.
  • Serves as the Lotterys primary point of contact for background investigation inquiries and provides expert guidance on complex or sensitive cases.
  • Advises leadership on background investigation outcomes and makes recommendations related to hiring licensing access or continued eligibility.

Security and Administrative Duties

  • Serves as the Lotterys lead authority on physical security systems facility access controls and security incident response.
  • Issues and manages employee identification badges and determines appropriate access levels based on the principle of least privilege.
  • Assesses and responds to security incidents threats or complaints determining appropriate corrective actions and documenting cases as required.
  • Provides security support within DOR facilities when operational needs or incidents require law enforcement presence.
  • Develops and delivers training and presentations related to security investigations and compliance for internal and external stakeholders.
  • Represents the Security & Investigations function in meetings briefings and before the Lottery Commission as assigned.

MINIMUM QUALIFICATIONS:

Experience Only:

Ten (10) years of progressively responsible professional investigative experience in a regulatory compliance or enforcement setting of which two (2) years must include direct supervisory experience over investigative or compliance staff.

AND

**Must possess a valid Colorado POST certification that is active in good standing and free of any restrictions suspensions or revocations at the time of applying**

OR

Education and Experience:

Bachelors degree in accounting business administration public administration criminology criminal justice criminalistics political science police science law enforcement law psychology sociology or a closely related field as determined by the Department.

AND

Six (6) years of full-time professional investigative experience in a regulatory compliance or enforcement setting of which two (2) years must include direct supervisory experience over investigative or compliance staff.

AND

**Must possess a valid Colorado POST certification that is active in good standing and free of any restrictions suspensions or revocations at the time of applying**.


Substitutions

Criminal Investigative experience in a field appropriate to the position may be substituted for the degree requirement only on a year-for-year basis.

Necessary Qualifications:

  • Applicants must successfully pass a background investigation and a tax check prior to appointment to positions in the Lottery Division.
  • Must possess and maintain a valid Colorado drivers license (at the time of application).
  • Must be able to pass a pre-employment background check.
  • Must pass a pre-employment Physical and Psychological evaluation.
  • Applicants must be willing to work nights rotating shifts weekends holidays and maintain on-call status while off-duty for emergency and supervisory response.
  • Maintains proficiency and qualification as required by Colorado P.O.S.T.
  • Must possess a valid Colorado POST certification that is active in good standing and free of any restrictions suspensions or revocations at the time of applying

  • Attends all DOR compliance training modules.
  • Certify and maintain certification in arrest control techniques.
  • Applicants must be willing and able to perform heavy lifting carrying or otherwise moving objects occasionally up to 100 pounds

Preferred Qualifications:

The ideal candidate will possess the following skills:

  • Knowledge of Colorado rules and regulation related to the Colorado Lottery
  • Demonstrated experience in communication and interpersonal oral and written communication skills.
  • Problem solving and troubleshooting skills.
  • Demonstrate the ability to plan and organize.
  • Ability to complete reports in a thorough accurate and concise manner.
  • Experience with rule making processes.
  • Experience supervising administrative investigations in a regulated environment.
  • Proven ability to learn new complex software and technical acumen.
  • Experience managing a geographically separated team.

Conditions of Employment:

Conditions of Employment with theCDOR:

Employees are in a position of public trust in the performance of their job duties and must operate in a manner that maintains the highest standards of honesty integrity and public confidence.

Final candidates must also complete a successful background investigation and reference check prior to appointment. Certain positions based on duties may require scheduled background investigations.

Pursuant to theUniversal Driving Standards Policy any worker who will be expected to drive a State-owned vehicle is responsible for maintaining a safe driving record and a valid driver license prior to driving any State-owned vehicle.

To be compliant with the new fleet vehicle policy Motor Vehicle Records (MVRs) will be pulled for review for workers who:

  • Have an assigned State fleet vehicle

  • Are required to operate a vehicle as part of the position

  • Utilize a State fleet vehicle as a pool vehicle
