The Department of Labor & Industries (L&I) is a diverse state agency dedicated to the safety health and security of Washingtons workers. As administrators of the states workers compensation system we are similar to a large insurance company providing medical and limited wage-replacement coverage to workers who suffer job-related injuries and illness. Our rules and enforcement programs also help ensure workers are paid what they are owed that childrens and teens work hours are limited and that consumers are protected from unsound business practices.

Insurance Services is the largest division within the agency and administers one of the premier workers compensation organizations in the nation serving over 3.8 million employees working for 260000 employers.

The Third-Party Unit is part of the Legal Services Division. Title 51 Chapter 24 allows for the recovery of civil damages; mandates the reimbursement of benefits; prevents double recoveries and ensures the responsible party pays for the accident. The role of the WCA4 Third Party Adjudicator is to review and analyze injured worker tort claim mediation and settlement requests obtain supporting and clarifying information for the tort claim and engage in the adjudication process settlement negotiations where indicated and appropriate with external parties. This position has extensive interaction with internal and external stakeholders including injured workers employers attorneys and lay representatives insurance adjusters tort claim mediators and the office of the Attorney General.


Duties

Some of what youll do:

  • Maintain caseload of Third Party claims.
  • Review analyze and use independent judgement to take appropriate action on assigned tort mediation claims and settlement requests.
  • Frequently communicate with injured workers/employers and/or employer representatives and their lay or legal representatives.
  • Compose and send correspondence.
  • Draft legal orders.
  • Consult with and mentor team members and other areas of the agency.

Qualifications

Required:

  • Bachelors degree in law business public administration or closely aligned field

AND

  • 3 years experience adjudicating workers or crime victims compensation insurance claims or adjudication of time loss payments insurance claims/adjusting or paralegal/law experience

*Additional relevant experience will substitute year for year for required education (Total 7 years of experience)

AND

  • Knowledge of Washington Workers Compensation law and personal injury law

AND

  • Demonstrated effectiveness interacting with a wide range of internal staff and external customers and stakeholders

Desired:

  • Experienced and highly skilled at mediation negotiation and conflict resolution of complex issues
  • Paralegal Certification (such as CP ACP etc.) or experience as a legal assistant
  • Knowledge of Tort law outside insurance industry and/or third-party claims administration
  • Demonstrated ability to engage in sophisticated analysis of complex issues
  • Ability to bring people together to find solutions to complex problems
  • Interpersonal skills and the ability to work effectively with diverse groups
  • Effectively communicate verbally and in writing
  • Demonstrated ability to proofread and finalize correspondence
