ASSISTANT CITY ATTORNEY

Department: City Attorney

Division: Legal

Pay Grade: GRADE 180: $103682.33 - $150339.37 Annual Salary

FLSA Status: Exempt Non-Merit Full-Time Eligible for benefits.

A preferred candidate will have transactional or litigation experience in real estate construction or business contracts.

GENERAL PURPOSE

This position provides legal advice to city representatives and employees represents the city in legal disputes or litigation relating to civil procedures and drafts various ordinances. Employees in this class have a higher level of practical experience in the field of legal counseling. The Assistant City Attorney receives directions from the Deputy City Attorney and the City Attorney. Exercises direct supervision of technical and clerical staff.

ESSENTIAL JOB FUNCTIONS

  • Provide legal advice to the Mayor City Council and city officials; evaluate policies and procedures and make recommendations.
  • Assist in the development of city policies; negotiate contracts; provide legal advice to city boards committees and commissions.
  • Develop and draft ordinances on city proposals or activities as needed.
  • Research legal questions and evaluate the impact on city policies and procedures.
  • Appear before courts and administrative proceedings to represent the citys interests as required.
  • Review workers compensation claims advise the HR/Risk Manager on legal issues and coordinate with outside legal counsel.
  • Review all Ogden redevelopment loans; initiate legal collections and foreclosure actions; represent the city as a creditor in Bankruptcy Court.
  • Coordinate office activities with those of other departments and outside agencies and organizations; provide staff assistance to the City Attorney; prepare and present staff reports and other necessary correspondence.
  • Act as liaison to the State Legislature.
  • Analyze state legislation and make recommendations as needed.
  • Participate in a variety of boards and commissions; attend and participate in professional groups and committees.
  • Prepare and review contracts deeds and other instruments.
  • Inspect and analyze legal papers or appeals filed with various city departments.
  • Participate in safety and risk management activities; take action to reduce liability to the city.
  • Attendance and punctuality are essential functions of this position.
  • Employees are required to work as a team and frequently meet with co-workers and supervisors.
  • Employees are required to communicate in person with the public during office hours and employees are required to use on-site equipment.
  • Perform other related duties as required/assigned.

SPECIAL REQUIREMENTS

  • Active membership in the State Bar of Utah.
  • Possession of or ability to obtain a valid Utah drivers license.
  • Employees will be required to complete NIMS IS100 IS200 ICS300 ICS400 IS700 IS800 IS701 IS702 IS703 IS704 IS706 IS775 IEMC course(s); and position specific ICS courses based on assignment.

EDUCATION AND EXPERIENCE REQUIREMENTS

  • Three years of increasingly responsible experience in city or related government law including trial experience.
  • Juris Doctorate from an accredited law school.
  • An equivalent combination of the above-stated work experience and education is acceptable.

KNOWLEDGE SKILLS AND ABILITIES

  • Knowledge of modern and highly complex principles and practices of public law.
  • Knowledge of the methods of public agency administration.
  • Knowledge of the organization duties powers limitations and authority of the city government and the City Attorneys office.
  • Knowledge of the legal principles practices and procedures of civil criminal constitutional and administrative law.
  • Knowledge of the legal principles practices and procedures of administrative land use real estate and zoning law.
  • Knowledge of the methods and techniques of legal research and writing.
  • Knowledge of established precedents and sources of legal reference applicable to city activities.
  • Knowledge of real property transactions in a variety of contexts such as historic environmental and commercial or residential development.
  • Skill in organizing interpreting and applying legal principles and knowledge of complex legal problems.
  • Skill in effectively applying legal knowledge and principles in court.
  • Skill in presenting statements of law fact and argument clearly and logically.
  • Skill in preparing and presenting difficult cases in court.
  • Skill in conducting research on complex legal problems and preparing sound legal opinions.
  • Skill in properly interpreting and making decisions in accordance with laws regulations and policies.
  • Skill in gaining cooperation through discussion and persuasion.
  • Skill in managing complex real property transactions including review of title documents and drafting necessary documents.
  • Ability to maintain effective audio-visual discrimination and perception needed for: making observations communicating with others reading writing and operating assigned equipment as required by the position.
  • Ability to maintain mental capacity allows for effective interaction and communication with others.
  • Ability to establish and maintain effective working relationships with those contacted in the course of work.
  • Ability to comply with all city policies and regulations including safety and risk management standards.

WORKING CONDITIONS & PHYSICAL REQUIREMENTS

  • The work environment is primarily in a courtroom setting where the noise and temperature levels are moderate. Employees may be exposed to hostile conditions.
  • The work is sedentary work which requires exerting up to 10 pounds of force occasionally and/or a negligible amount of force frequently or constantly to lift carry push pull or otherwise move objects including the human body.
  • Must possess the physical ability to work primarily with fingers perceive the nature of sounds make rational decisions through sound logic and deductive processes express or exchange ideas by the spoken word make substantial movements (motions) with the hands wrists and/or fingers and discern letters or numbers at a given distance.
  • Additionally the following physical abilities are required: grasping handling hearing manual dexterity mental acuity reaching repetitive motion speaking talking visual acuity and walking.
