Course Description:

This course is designed to teach the key elements of the law of Consultation with First Peoples that can later be used in the context of negotiation litigation and advisory legal practice. It will have an experiential learning component to help build practices skills in the context of First Nation Metis and Inuit clients or partnerships. Much of the discussion and activities will be presented in a Seminar style. Students may also have an opportunity to work in teams for periods on location at an Indigenous Lands and Consultation Hub at 1 Stewart Street. At the Hub students will be supervised as they support the preparation pf client friendly information and advice on various lands and consultation issues related to rights under s. 35 of the Constitution Act 1982.
The in class learning component will include perspectives from the practice of Indigenous law in the Canadian legal context and include some guest discussions of traditional considerations and practices. Note that this class study is distinct from the study of customary Indigenous law. There will also be significant focus on Crown consultation with various industries such as mining forestry fishing environmental review and assessment and infrastructure. Participants will learn to navigate broad practice areas all centred on the law of consultation on rights title and outstanding s. 35 claims.
An initial aspect of the course will involve a more technical review of the large body of jurisprudence cutting edge issues and future visioning.
The next aspect of the course will involve student participation at the Lands and Consultation Hub in preparing client friendly legal education case summary and advisory tools for Indigenous leadership and lands technicians.
The final aspect will include experiential learning and practice advising on First Nations consultation issues.

Requirements:

The Common Law Section is seeking candidates who are leaders in the legal profession. The Prison Law Clinic course is online. An LL.B. J.D. or equivalent is for this position. Active membership in good standing in the Law Society of Ontario and Lawpro insurance are also . The successful candidate will have significant practical experience related to prison law. Prior teaching experience will be considered an asset.

The Common Law Section reserves the right to select a candidate who does not fully meet each of these requirements where the candidates selection would be beneficial to the program the course the students or for a related reason.
