Job Description

KNOWLEDGE SKILLS AND ABILITIES:

If you are the right person for this opportunity you will have the following knowledge skills or abilities:

Knowledge of (or ability to learn in a reasonable amount of time):

  • Montanas laws or a similar states laws regarding unemployment insurance.
  • Federal labor and employment laws
  • The Administrative Rules of Montana
  • Hearing Procedures
  • The rule of civil procedure
  • The rules of evidence

Skill in:

  • Ensure hearings are orderly conducted fairly and safeguard the rights of the involved parties. The incumbent must preside over the prehearing procedures and the hearing with dignity decorum and authority and must maintain control with impartiality.
  • Explain the law and procedure at the start of the hearing process provide clear expectations to the parties and assist in the development of testimony. The incumbent must be able to directly examine witnesses and evaluate their testimony.
  • Analyze and evaluate hearings records including exhibits in contested case proceedings involving attorneys agency staff and the public.
  • Define analyze and evaluate multiple issues at hearing that lack clarity or specificity in the law or administrative procedures.
  • Use logic to analyze or identify underlying principles reasons or facts associated with information or data to draw conclusions.
  • Apply and analyze past legal and administrative decisions rulings precedents decisions and principles to specific situations.

Ability to:

  • Identify essential facts issues or potential issues during the course of hearings.
  • Follow oral and written arguments and identify and apply appropriate law to essential facts and key issues.
  • Write clear concise well organized and legally sufficient decisions and orders.
  • Communicate effectively orally and in writing as appropriate for the needs of the audience.
  • Use logic and reasoning to identify the strengths and weaknesses of alternative solutions conclusions or approaches to issues.
  • Determine the credibility of witnesses and their testimony from the voice manner of presentation and demeanor of the witness and from the quality and consistency of the testimony and evidence presented.
  • Effectively manage a large caseload to insure timely resolution of cases.

MINIMUM QUALIFICATIONS

Candidates with a strong mix of the attributes listed in the above Knowledge Skills and Abilities (KSAs) are desired. Candidates may demonstrate competency in the KSAs through experience formal education (including certificates credentials or degree-based programs) or a combination of both. Any combination of equivalent experience and education to successfully perform the essential functions of the position will be considered.

  • Juris doctorate degree.
  • Four years of job-related experience in legal writing conducting legal research litigation administrative law administrative hearings processes and procedures and adjudication of contested cases.

OR

  • Other combinations of directly related education and experience may be substituted.
