Job Summary

To ensure proper action is taken to follow the current Bankruptcy laws to protect the member and the Credit Union. This position is responsible for the daytoday processing of incoming federal bankruptcy pleadings including but not limited to bankruptcy filing notifications discharge orders and dismissal orders. This position is also responsible for explaining the actions taken by the Credit Union (e.g. account maintenance legal action) to members branches Credit Union departments bankruptcy trustees and to the members and the Credit Unions legal representatives.

SCHEDULE

Monday through Friday 8:00 AM 4:30 PM or 9:30 AM 6:00 PM

To be effective an individual must be able to perform each job duty successfully.

  • Reviews all incoming federal bankruptcy court documents and examines filed pleadings to determine appropriate action.
  • Processes federal bankruptcy court documents such as bankruptcy filing notifications discharge orders and dismissals.
  • Ensures the correct steps are taken to file maintain an account to abide by the Bankruptcy laws; verifies that correct steps are taken in account review and in any necessary collection process to avoid violation of the Automatic Stay and/or any other bankruptcy code.
  • Responsible for preparing and filing proof of claims and reaffirmation agreements in various jurisdictions of the federal bankruptcy court system.
  • Ensures trustee payments are being received.
  • Assists with monitoring for compliance with the members Chapter 7 Statement of Intention or the Chapter 13 Plan by following up on assigned queue.
  • Works directly with attorneys to ensure proper steps are taken; refers routine legal action to Credit Unions attorney networks including Motions for Relief from the Automatic Stay and Objections to Confirmation.
  • Recommends accounts for repossession and where necessary other collection action.
  • Answers incoming calls from members members legal representatives the Credit Unions legal representatives and bankruptcy trustees; responsible for accurately answering questions and resolving routine issues related to these processes.
  • Answers incoming calls from branches service center and other departments to provide overrides.
  • Assists in researching accounts and taking appropriate action as recommended by manager.
  • Exemplifies role as a team member to promote and maintain effective partnerships with the team and the Credit Unions members.
  • Incorporates MACU values and philosophy while fulfilling responsibilities as a representative of the Asset Management department and the Credit Union.

Experience

3 years professional experience in a progressive financial setting with 35 years of working in a bankruptcy position law firm specializing in credit representation or trustees office with experience in bankruptcy case management.

Education

  • High school diploma or equivalent.
  • Coursework in banking and credit collection law are preferred

Computer/Office Equipment Skills

  • Intermediate skills with Microsoft Office Suite including Outlook Word PowerPoint and Excel
  • Knowledge of and proficiency with PACER CM/ECF filing preferred and Trustee websites (13network and/or NDC)
  • Demonstrated experience with Symitar preferred

Language Skills

  • Demonstrated ability to clearly express ideas verbally and in writing
  • Demonstrated ability to document outcomes and present information in a manner appropriate for key stakeholders and all levels of the organization.
