TD Legal is dedicated to providing industryleading advice and counsel to TD business segments and corporate functions. In this Senior Counsel Canadian Disputes and Investigations Litigation role you will join a dynamic and collegial team of legal professionals who provide advice in respect of a range of litigation risks for the enterprise. The role is intended to be dynamic with the successful candidate offering support to teams within the legal department and lines of business on a variety of issues. Job Description/Accountabilities:
This is a senior role in the area of litigation with principal accountability in the areas of strategic and tactical advice counsel influence relationships and oversight development of others and special projects. The role will manage litigation from the retail wealth and wholesale (capital markets) lines of business with an emphasis on wealth and wholesale matters.
Manage external counsel in all aspects of litigation at all levels of court in Ontario and other provinces to develop and implement strategy for the resolution of litigation. Please note that this role does not involve direct incourt advocacy.
Identifying key legal risks and mitigation strategies while ensuring awareness among relevant stakeholders and other members of the TD Legal team.
Provide best in class litigation advice that is integrated with the strategies and objectives of the business and consistent with the enterprisewide risk policy.
Provide advice to other members of the Legal Department and the applicable lines of business with respect to contractual interpretation and drafting prelitigation dispute resolution and litigation risk analysis.
Manage privileged internal investigations and provide legal advice to relevant stakeholders on privilege and best practices.
Provide regular oral and written reporting to senior members of the Litigation Department and other control groups business executives and various risk committees.
Provide guidance and training to business and legal partners through presentations on best practices developments in the law and emerging risk areas.
Support development and/or implementation of policies procedures and solutions that mitigate risk and enable the achievement of business/enterprise priorities.
Work closely with other control groups. Build and maintain positive working relationships by effectively communicating and regularly sharing information learnings and knowledge with internal and external business partners.
Contribute to high priority special projects and other Legal Department initiatives.
Qualifications/Skills/Experience:
Law degree from an accredited law school and qualified to practice law in Ontario.
Possess 7 years of postcall litigation experience working with a law firm inhouse or financial services regulator.
Experience litigating large complex civil and/or regulatory matters in the corporate commercial and/or securities space.
Advanced ability to identify problems and barriers and effectively implement solutions to further business strategy.
Advanced ability to operate with creativity and innovation and a desire to seek different perspectives and new ideas.
Demonstrated excellence in judgment leadership and relationship management skills.
Strong analytical and problemsolving skills.
Solid collaboration and teambuilding skills.
Flexibility to quickly adapt to changing and ambiguous initiatives or requirements.
Ability to work effectively across and throughout the enterprise with teams and independently.
Ability to multitask and operate autonomously on a daytoday basis with limited supervision is critical.
Advanced ability to communicate complicated legal issues in a clear succinct and effective manner to business clients and other professionals both verbally and in writing.
Bilingualism would be considered an asset but not necessary.
Securitiesrelated litigation experience would be considered an asset but not necessary.
Strong technology aptitude including (i) proficiency with standard office software and ability to learn and apply new technologies in work environment and (ii) capacity to understand current and emerging technologies in the industry and how they affect business objectives.
