Job Description

The Clover legal team is a small and nimble group that takes on novel issues that require creative solutions. You are joining a smart and spy group of inhouse lawyers where you will proactively address legal matters that challenge you to think differently. As a key member of the team you will work closely with the companys business leaders to anticipate and develop legal solutions.

Were looking to hire a Senior Litigation & Product Counsel to our team! In this role you will be responsible for helping 1 manage the companys portfolio of actual and threatened litigation and regulatory investigations; 2 assess the litigation and regulatory risk of various company processes initiatives and communications; and 3 develop risk mitigation strategies. In addition you will assist in drafting and negotiating customer contracts for Counterpart Health a Clover subsidiary focused on enabling thirdparty payors and others to succeed in valuebased care through use of Clovers proprietary technology platform Counterpart Assistant.

As our Senior Litigation & Product Counsel you will:

  • Manage the companys portfolio of actual and threatened litigation and regulatory investigations by conducting legal research and internal factfinding and helping supervise outside counsel.
  • Conduct internal investigations of potential regulatory violations raised through the companys various reporting channels.
  • Provide the companys Medicare Advantage and Counterpart Assistant teams with practical daytoday legal advice regarding Centers for Medicare and Medicaid Services (CMS) regulations the AntiKickback Statute (AKS) the False Claims Act (FCA) and the Health Insurance Portability and Accountability Act (HIPAA).
  • Proactively identify areas of litigation and regulatory risk and develop strategies to mitigate such risk.
  • Draft and negotiate customer contracts for Counterpart Health.

Success in this role looks like:

  • In your first few months you have built trusting relationships with stakeholders across the business setting you up to be a strategic legal business partner.
  • Within your first six months you have proactively identified and partnered to resolve risk areas cementing your role as a trusted partner and advisor.
  • Long term your understanding of Clovers business units and product offerings investigative fortitude and reliable business partnership skills serve as a force multiplier for our growing legal function.

You should get in touch if:

  • You have a J.D degree from an accredited law school.
  • You have at least four years of litigation and/or internal investigations experience at a large law firm and/or health insurance company.
  • You have experience working with health insurance clients especially in the managed care space and are familiar with the AKS FCA and HIPAA.
  • You have experience helping clients develop strategies to mitigate litigation and regulatory risk.

A reasonable estimate of the base salary range for this role is $189000 to $231000. Final pay is based on several factors including but not limited to internal equity market data and the applicants education work experience certifications etc.
