Position: CONTRACT SPECIALIST

Purpose:

  • Precontract review negotiation and drafting of NEC FIDIC EPC/EPCM Contracts and general subcontract supply services and purchase agreements.
  • Postcontract claim and dispute management arising from time to time during project execution involving extension of time Force Majeure and scope variation claims.
  • Postcontract award administration activities assessment of extra work authorizations & claims direct supplier liaison & generally all other activities associated with the administration of Electrical Mechanical Structural and Civil related contracts under an EPC/EPCM authority.
  • Drafting of contractual correspondence while rapidly assembling and distributing contractual notices (including claims impact notices and early warning notices).
  • Timeously adapted schedules to incorporate any changes arising from correspondence claim notices performance guarantees and retention to mitigate unsolicited risks.

Roles and Responsibilities:

  • To be familiarized with the specific project contract document its scope of work general and particular conditions and to use all resources and remedies under the contract in order to ensure that the supplier/contractor meet its contractual obligations.
  • To actively promote and coordinate effective communication between the Construction Manager the Project Manager the Contracts Manager the Project Planner the Project Quantity Surveyor Quality Safety Document Control and any other relevant party (the Parties).
  • To work closely with the Parties monitor the contract progress record any possible delays (no access) and any possible disruptions (any event preventing the contractor from performing its duties) which may lead to contractual notifications or claims. This role may also full the role of a contract planner in certain instances.
  • Ensure that Daily Dairies are completed every day and that Early Warnings Impact Notices Claim Notices and Fully Detailed Claim submission are drafted and being issued within the contractual allowed time periods.
  • Maintain the correspondence register by keeping track of letters issued and received and to ensure that letters received are actioned by the relevant parties where applicable.
  • Maintain an Early Warning register (EWs issued and EWs received) and monitor the status of each EW on a weekly basis after the progress meeting during the risk reduction meeting.
  • Maintain and monitor the Engineers Instruction register the Impact Notice register Variation Order register and the Claims register (ensure that fully detailed claim submissions are submitted subsequent claim notifications).
  • Perform productivity assessments on the contract personnel and assess the cost benefit ratio of site personnel vs. actual work completed.
  • Prepare and review reports for the Project/Contract Manager as follows; cost reports progress reports productivity reports cost benefit analysis reports.
  • Assist the Construction Manager/Quantity Surveyor in costing of variations.
  • Document and record all contractual correspondence from Wade Walker to the main contractor and or client.
  • Notify the Project/Contract Manager should there be any pending contract variations either technical or financial and implement the Project/Contract Managers decisions.
  • Assist the Project/Contract Manager in compiling progress payments.
  • Assist the Construction Manager on daily correspondence with the main contractor and or client.
  • Assist the Project/Contract Manager with the justification or substantiation of any submitted claims. This is based on the Contract Administrator keeping clear and concise records of all correspondence all changes to scope all variations all delays all disruptions all late delivery of materials and any other Contract related issues.
  • Assist the Project/Contract Manager with the formulation and submission of the contract final account.

Requirements

  • Commercial Law Degree or similar.
  • 5 year(s) onsite working experience associated with EPC/EPCM contracts.
  • Extensive knowledge of construction contracts such as NEC FIDIC EPC and EPCMrelated agreements.
  • Excellent communication skills both written and verbal.
  • High level of personal integrity selfdisciplined and a positive attitude.
  • Be able to work with multifunctional departments/offices and people.
  • Deadlinedriven attention to detail and able to perform under pressure.
