Job Summary:

The Vanderbilt University Medical Center Office of Legal Affairs is looking for an exceptional individual with a minimum of 3 years of experience advising complex healthcare organizations on all aspects of healthcare system operations to join its team. The ideal candidate will have experience advising hospitals and ambulatory clinics on employment matters patient care issues accreditation and professional licensure scope of practice fiduciary relationships in the healthcare environment mandated reporting privacy and release of information and general healthcare regulatory requirements related to the provision of healthcare. Preference will be given to candidates with experience advising academic medical centers or with other significant relevant experience. The successful candidate will possess excellent oral and written communication skills and will have the ability to work both independently and as part of a team within a dynamic environment. Excellent client management skills the ability to prioritize competing demands and the ability to balance risk with organizational goals are necessary. This individual will report to the Managing Counsel for Hospital Operations Privacy & Release of Information and Labor/Employment & Medical Staff Matters.

Role Accountabilities:

• Support theoperationalactivities oflarge healthcareenterpriseconsisting of anacademic medical center acute care community-basedhospitals and ambulatoryclinics.

• Advise on adultpediatricand behavioral health patient-relatedissuesincludingrefusalofand consent to treatment advanced directivessurrogate decision making guardianshipsconservatorships and end-of-life issues ethical and legal conflicts between patientsfamiliesand healthcare. providersandabuse and neglect issuesand mandated reporting requirements.

• Provideguidance andassistanceinresponding torequests for protected health information from third parties including government agencies law enforcement payors providers attorneysand others including third party requests for communicationwithand testimony byhealthcare providers.

• Partner with content expertsacross the enterprisein the development of policies and proceduresrelated to daily hospital and ambulatory operationsandassistin educational activities to support policyapplication andcompliance.

• Advise onscope of practice and professionallicensuremattersandcommunicatewith licensure agencies on behalf of the organizationas needed.

• Support Accreditation and Standards insite surveys and responses to requests for information.

• Advise healthcare administrators and human resources professionals on the full array of employment and labor related issues arising out of the operation of a major healthcare system including issues related to the development interpretation and enforcement of employment agreements policies and relevant laws the discipline and termination of employees workplace accommodations the administration of employee leaves wage and hour issues workplace safety and internal investigations.

• Respond to offer guidance on and coordinate with outside counsel on the handling of employment-related administrative and judicial actions proceedings and subpoenas including information and document requests from administrative agencies such as the Equal Employment Opportunity Commission the National Labor Relations Board the Department of Labor the Occupational Safety and Health Administration and comparable state agencies as well as demand letters from opposing counsel.

• Address employment issues that are intertwined with privacy patient care and safety credentialing and other healthcare related issues.

• Assistin providingtraining and education to human resources professionals and others within the healthcare organization on changes in and compliance with the applicable labor and employment laws.

• Provide guidanceand drafting support for respondingto requests for information from third partiesin the context of EEOC OSHA TOSHA and related.

• Attend and activelyparticipateas a legal advisorto multiple system committees.

• Collaborate with stakeholders at all levels of the organization toidentifyand mitigatelegal and regulatory risks of proposed initiatives.

• Participate in departmental after hours call schedule toprovidelegal advice on urgent patient mattersarisingoutside of normal business hours.

• Provide regulatoryand other operationalsupport on contract and transactional matters in which VUMC may engage.
• Collaborate with and manage outside legal resources.
• Provide guidance andassistanceto other colleagues in the Office of Legal Affairs in a highly collaborative and team-oriented fashion.

Qualifications:

• JD degree from an ABA accredited law school.
• 3years or more of directly applicable experience with at least three (2) of those years providing legal advice andassistanceto healthcare institutions or companies.
• Employment contingent upon State of Tennessee licensure or registration and receipt of In-House Counsel Practice Certificate. The successful candidate must also apply for and become licensed in the State of Tennessee within 12 months of employment or if earlier the date required under applicable rules of the Tennessee Supreme Court.
