1. Introduction and Scope
These Employers Terms of Service (the "Terms"), together with the Privacy Policy, Cookie Policy, Intellectual Property Policy, and any additional policies, guidelines, notices, or agreements referenced herein or published on the Platform (collectively, the "Agreement"), constitute a legally binding agreement between you ("Employer," "you," or "User") and Dr Job FZ LLC, a company incorporated under the laws of the United Arab Emirates ("Dr.Job," "we," "us," or "our").
By accessing or using the services provided through www.drjobpro.com, its subdomains, mobile applications, APIs, or any related digital interfaces (collectively, the "Platform"), you acknowledge that you have read, understood, and agreed to be bound by this Agreement.
If you do not agree with any part of these Terms, you must not access or use the Platform.
Dr.Job reserves the right to amend, modify, or update these Terms at any time at its sole discretion. Any such amendments shall become effective immediately upon publication on the Platform. Your continued use of the Platform following the posting of changes shall constitute your binding acceptance of the revised Terms.
2. Definitions
Unless the context otherwise requires, the following definitions shall apply:
- Account: The registered account created by an Employer to access the Services.
- Content: Any information, data, text, graphics, audio, video, job postings, messages, documents, or other materials submitted, uploaded, generated, or transmitted through the Platform.
- Employer: Any individual or legal entity that registers on the Platform for recruitment, hiring, or talent acquisition purposes.
- Services: All tools, systems, features, software, and functionalities provided by Dr.Job, including but not limited to job postings, applicant tracking, AI-powered screening, interview management, analytics, communications, and offer letter generation.
- Third-Party Services: External software, services, platforms, or integrations not owned or controlled by Dr.Job.
3. Nature of the Platform
Dr.Job operates as an AI-first Recruitment Operating System (R-OS) that provides technology-based tools intended to assist Employers in managing recruitment workflows.
Dr.Job is not a recruitment agency, employment agency, headhunter, staffing firm, or labor intermediary. Dr.Job does not participate in, control, or assume responsibility for hiring decisions, employment negotiations, employment contracts, or employer-candidate relationships.
All AI-powered tools and automation features are provided strictly for decision-support and workflow-optimization purposes. Final hiring decisions remain the sole and exclusive responsibility of the Employer.
Dr.Job makes no representations or warranties regarding:
- Hiring outcomes
- Candidate suitability
- Time-to-hire
- Business performance
- Revenue impact
- Employment success
4. Platform Availability and Maintenance
Dr.Job shall use commercially reasonable efforts to maintain Platform availability. However, continuous, uninterrupted, or error-free operation is not guaranteed.
The Platform may be temporarily unavailable due to scheduled maintenance, system upgrades, technical failures, cybersecurity incidents, force majeure events, or circumstances beyond Dr.Job’s reasonable control.
Dr.Job shall not be liable for any losses, damages, delays, or missed opportunities resulting from Platform downtime or performance interruptions.
5. Eligibility and Registration
5.1 Eligibility
By using the Platform, you represent and warrant that:
- You are at least eighteen (18) years of age;
- You have the legal capacity to enter into binding contracts; and
- Where applicable, you are authorized to bind the entity on whose behalf you are acting.
5.2 Registration Obligations
You agree to provide accurate, complete, and up-to-date information during registration and to keep such information current.
You are solely responsible for maintaining the confidentiality of your Account credentials and for all activities conducted through your Account.
Dr.Job shall not be liable for any loss or damage arising from unauthorized access resulting from your failure to safeguard your credentials.
6. Plans, Subscriptions, and Modifications
Dr.Job offers multiple subscription plans, including free and paid tiers. Features, limits, storage capacity, support levels, and functionality vary by plan.
Dr.Job reserves the right, at its sole discretion, to:
- Modify, suspend, or discontinue any plan or feature;
- Introduce new plans or pricing models; and
- Reclassify Services.
Such modifications may be implemented with or without prior notice, subject to applicable law.
7. Usage Limits
Your use of the Services is subject to plan-based limits, which may include but are not limited to job postings, AI credits, candidate views, storage capacity, communications, and interviews.
Exceeding applicable limits may result in restricted functionality, temporary suspension of features, or access limitations.
8. Upgrades and Downgrades
You may upgrade or downgrade your subscription at any time.
In the event of a downgrade:
- Your Account shall remain active;
- Certain features, data access, or integrations may be restricted or removed; and
- Historical records, exports, or premium functionalities may no longer be accessible.
Dr.Job shall not be responsible for any data loss, functionality loss, or operational limitations resulting from a downgrade.
9. Fees, Billing, and Refunds
Certain Services require payment of fees. All fees are billed in advance on a monthly or annual basis unless otherwise stated.
All fees are non-refundable, except where required by applicable law or expressly stated in writing by Dr.Job.
Dr.Job reserves the right to modify pricing, introduce new charges, apply discounts, or implement promotional campaigns at its discretion. Prices are subject to change in accordance with company policy. Customers will be notified at least one (1) month in advance before any pricing changes take effect.
10. Content Moderation and Enforcement
All Employer Content is subject to review for compliance with these Terms, applicable laws, and Platform policies.
Dr.Job reserves the right, without obligation, to edit, refuse, suspend, or remove any Content at its sole discretion.
11. Employer Responsibilities and Content License
You retain ownership of your Content. However, by submitting Content, you grant Dr.Job a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, host, store, reproduce, display, distribute, modify, and process such Content solely for the purposes of operating, improving, securing, and promoting the Platform.
You represent and warrant that you possess all necessary rights to submit such Content and that it does not violate any applicable law or third-party rights.
12. Artificial Intelligence and Automation Disclaimer
AI-powered tools are provided on an "as is" basis and are intended solely to assist with screening, ranking, automation, and workflow efficiency.
Dr.Job does not warrant that AI-generated outputs are accurate, complete, unbiased, or legally compliant.
Employers remain solely responsible for verifying all AI-generated insights and making independent hiring decisions.
13. Video Interviews, Recordings, and Compliance
Where video interviews, recordings, or voice data are used, the Employer is solely responsible for obtaining all legally required consents and complying with applicable data protection, employment, and labor laws in relevant jurisdictions.
Dr.Job disclaims all responsibility for consent management or regulatory compliance related to such recordings.
14. Third-Party Services and Integrations
The Platform may integrate with Third-Party Services. Dr.Job does not control, endorse, or assume responsibility for such services.
Dr.Job shall not be liable for any failures, interruptions, inaccuracies, or damages caused by Third-Party Services.
15. Communications
By using the Platform, you consent to receiving transactional, operational, service-related, and promotional communications via electronic means.
16. Prohibited Conduct
You agree not to use the Platform for any unlawful, misleading, abusive, defamatory, or harmful purpose or in violation of applicable laws, including but not limited to the laws of the United Arab Emirates.
17. Disclaimer of Warranties
The Services are provided on an "as is" and "as available" basis. Dr.Job disclaims all warranties, whether express, implied, or statutory.
18. Limitation of Liability
To the maximum extent permitted by law, Dr.Job shall not be liable for any indirect, incidental, consequential, exemplary, or special damages.
19. International Use and Compliance
Employers accessing the Platform from jurisdictions outside the United Arab Emirates do so at their own risk and are solely responsible for compliance with local laws.
Dr.Job makes no representation that the Platform is appropriate or available for use in all jurisdictions.
20. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates.
The courts of the United Arab Emirates shall have exclusive jurisdiction over all disputes arising from or relating to these Terms.
21. General Provisions
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
These Terms constitute the entire agreement between the parties and supersede all prior agreements or understandings.
22. Data Protection, Privacy, and Regulatory Compliance (GDPR & UAE PDPL)
Dr.Job processes personal data in accordance with applicable data protection laws, including but not limited to the European Union General Data Protection Regulation (Regulation (EU) 2016/679) ("GDPR") and the UAE Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data ("UAE PDPL").
Employers acknowledge that they act as the "Data Controller" for candidate and applicant personal data, while Dr.Job acts as a "Data Processor" unless otherwise stated.
Employers represent and warrant that they have obtained all necessary consents, notices, and lawful bases for processing, transferring, and storing personal data uploaded to the Platform.
Dr.Job shall implement appropriate technical and organizational measures designed to protect personal data, as further described in it
23. Information Security
Dr.Job implements and maintains commercially reasonable administrative, technical, and physical safeguards designed to protect Employer data and Platform systems against unauthorized access, disclosure, alteration, or destruction.
Such safeguards may include, where appropriate, access controls, authentication mechanisms, encryption, logging and monitoring, backup procedures, vulnerability management, and incident response protocols. However, the Employer acknowledges that no method of electronic transmission or data storage is completely secure.
Accordingly, Dr.Job does not warrant or guarantee that the Platform will be immune from cyber threats, hacking attempts, malware, denial-of-service attacks, or other security incidents, and shall not be liable for any unauthorized access, data loss, or system compromise that occurs despite the implementation of reasonable security measures.
The Employer is solely responsible for:
- (a) Maintaining the confidentiality and security of its login credentials;
- (b) Implementing appropriate internal access controls and security policies;
- (c) Ensuring that only authorized personnel access the Account; and
- (d) Immediately notifying Dr.Job of any suspected or actual unauthorized access or security breach relating to its Account.
Dr.Job reserves the right to suspend access to the Platform, in whole or in part, without liability, where necessary to protect the security, integrity, or availability of the Platform or to prevent harm to Dr.Job, Employers, candidates, or third parties.
