The Division of Economic and Financial Opportunity (DEFO) is committed to encouraging a competitive and diverse New York City business environment by promoting the growth and success of small businesses with special emphasis on historically underserved groups and ensuring their meaningful participation in the government procurement process. DEFO assesses the eligibility of businesses for certification through the Citys Minority and Women-owned Business Enterprise (M/WBE) Locally Based Business Enterprise (LBE) and Emerging Business Enterprise (EBE) Certification Programs delivers services to help firms grow through government contracting and oversees the compliance of citywide vendors with equal opportunity mandates and MWBE participation related requirements on Industrial and Commercial Abatement Program (ICAP) projects.

Unit Description
The Division of Labor Services (DLS) Unit ensures that jobs created by New York City contracts and the Industrial and Commercial Abatement Program (ICAP) are available to all qualified individuals regardless of race creed color national origin sex age disability marital status sexual orientation or citizenship status. The Unit helps contractors implement fair employment policies and practices and assists them in their efforts to increase the representation of minorities and women in their workforce.

The Unit enforces Executive Order No. 50 which requires City contractors comply with federal state and local equal employment opportunity (EEO) laws and regulations. Prior to the award of a City contract or ICAP benefit a contractor must submit an Employment Report containing information on their employment policies and practices and workforce composition. DLS will analyze the report to determine if the contractor maintains nondiscriminatory hiring and employment practices. DLS also enforces Local Law 67 of 2008 which requires that all ICAP developers participate in the Citys Minority and Women-owned Business Enterprises (M/WBE) program.

Job Description:
Under supervision of the Chief Vendor Compliance Officer DLS is seeking a Director of Compliance to support unit activities in ensuring ICAP and EO 50 adherence across all qualifying entities performing work with the City of New York as prescribed by Executive Order No. 50 94 and/or Local Law 67.

Key Responsibilities

Compliance Oversight:
- Finalizing EO 50 Compliance determinations for ICAP Construction and Supply and Services Employment Reports
- Overseeing DLS audits to ensure EO 50 compliance and EEO Sexual Harassment FMLA and Collective Bargaining Agreement (CBA) requirements
- Serving as the DLS liaison with SBS Technology Team for technological updates and change management including updates related to MS Dynamics CRM implementation changes testing bug fixes troubleshooting etc.
- Conducting periodic meetings with agency representatives and/or vendors to assist with EO 50 compliance
- Performing periodic reporting to assess program project and entity level progress and performance
- Supporting efforts to streamline processes and procedures related to M/WBE utilization Field Audits and Workforce Analysis

Supervision and Management:
- Managing and supporting DLS Staff duties performance and responsibilities
- Creating staff Task & Standards and conducting yearly performance evaluations
- Overseeing unit outreach efforts and development of unit promotional materials
- Providing continued training and development opportunities for DLS staff
- Managing and assisting with special projects as needed

Collaboration and Communication:
- Manage and maintain clear communication with city agencies whose vendors are covered by EO 50 and the ICAP MWBE program
- Facilitate regular updates and informational sessions to ensure alignment across agencies
- Ensure proper communication with vendors regarding compliance requirements and non-compliance issues.
- Help to develop accessible resources and tools to assist vendors in meeting compliance standards
- Act as a liaison between DLS/SBS and other internal divisions such as legal procurement communications technology and intergovernmental affairs
- Coordinate with external agencies such as the Office of Administrative Tribunals and Hearings (OATH) the NYC Commission on Human Rights and state/federal regulators on labor compliance matters
- Maintain cooperative relationships with reporting staff and other colleagues

Additional Information

This position may be eligible for remote work up to 2 days per week pursuant to the Remote Work Pilot Program agreed to between the City and DC37. Per this program employees will be required to report to the workplace in person based on operational need when directed by management.


Residency Requirement

New York City residency is generally required within 90 days of appointment. However City Employees in certain titles who have worked for the City for 2 continuous years may also be eligible to reside in Nassau Suffolk Putnam Westchester Rockland or Orange County. To determine if the residency requirement applies to you please discuss with the agency representative at the time of interview.

Qualifications :

1. A masters degree from an accredited college with a major in business administration public administration urban planning economics urban affairs marketing research finance or political science; or

2. A baccalaureate degree from an accredited college and one year of full-time satisfactory experience in one or more of the following:
a. business development retention expansion and relocation or assisting businesses in accessing public and private services and programs including workforce development; or
b. analysis of business records and documents to determine eligibility of businesses for programs and services; or
c. economic market or site research and analysis for business and neighborhood development; or
d. facilitation and promotion of the film industry through the processing of various permits marketing techniques and incentive programs; or

3. An associate degree or 60 semester credits from an accredited college and three years of full-time satisfactory experience as described in 2 above; or

4. A satisfactory combination of education and experience which is equivalent to 1 2 or 3 above. However all candidates must have least 60 semester credits from an accredited college or university.
