The Department of Public Safety and Correctional Services (DPSCS) is seeking dedicated candidates to fill important roles within our department. Main Purpose of Job

Serves as the statutory Executive Directorspecified in Md. Code Ann. Corr. Serv. 10-203(a) and as such the chiefexecutive officer of the Inmate Grievance Office (AGO) to carryout all of the duties and responsibilities specified in Md. Code Ann. . 10-201 et seq. and C.O.M.A.R. 12.07.01 et seq.

Serves as Department of Public Safety andCorrectional Services member of the Sundry Claims Board and administrativelyprocesses claims filed by incarcerated persons who are injured in the course oftheir job duties in the Division of Correction.

Coordinates with the Office of the AttorneyGeneral for the preparation and filing of certified administrative records inState court proceedings for the judicial review of the final administrativedecisions in inmate grievance cases. and responds as appropriate to remands bythe courts in these proceedings. Responds to inquiries and documentary requestsfrom the Office of the Attorney General arising from Federal and State courtcivil actions filed by inmates by advising whether related inmate grievanceshave been filed and by preparing appropriate affidavits for submission to thecourts.

As a member of the Sundry Claims Boarddesignated by the Secretary of Public Safety & Correctional Services andas the Secretary of the Board appointed by the Governor administers alloperations of the agency creates or maintains all agency records and conductsa quasi-judicial Administrative process that includes without limitation: areview of each claim filed with the agency; the collection of information anddocumentation pertaining to the claim; communication with the claimant or theclaimants attorney; the arranging of a hearing venue; the scheduling ofhearings; the arranging of independent medical evaluations as needed; thedrafting of all final decisions for review by the other members of the board;the issuance of all final decisions; the processing of all monetary awards; andthe preparation and certification of administrative records for State courtcivil proceedings for judicial review.

Conducts a quasi-judicial administrativeprocess by which all inmate grievances filed with the agency are given apreliminary review leading to either a final administrative decision to dismissthe grievance as factually without merit or a referral of the grievance to theOffice of Administrative Hearings for an evidentiary hearing to be conducted byan Administrative Law Judge. Reviews and responds as appropriate to inmatecorrespondence concerning grievances. As to grievances referred to the Officeof Administrative Hearings for a hearing; schedules the hearing; makespreliminary pro0cedural decisions concerning grievant requests for inmaterepresentation witnesses documentary evidence and postponements; andarranges for the presence at the hearing of appropriate individuals (inmatesstaff and others) and documentary evidence.

As the agency headappointed by and serving at the pleasure of the Secretary with the approval ofthe Governor administers all operations of the agency including withoutlimitations: strategic planning; the preparation presentation andadministration of the annual budget; the hiring training supervision anddiscipline of agency personnel; the coordination of the agencys operationswith those of the other agencies and units within the Department of PublicSafety & Correctional Services and with the Office of Administrative Hearings;the creation and maintenance of all agency records; the maintenance andreporting of agency statistics for the Managing For Results process; and theresponse to all inquiries from Maryland State officials and employees andmembers of the public.

MINIMUM QUALIFICATIONS

Education: Juris Doctor(J.D.) degree from a law school accredited by the American Bar Association(ABA) at the time of appointment.

Experience:At least six (6) years of progressively responsible experience in the practice of law administrative law corrections law governmental operations or quasi-judicial proceedings.

DESIRED OR PREFERRED QUALIFICATIONS

  • Experience conducting or overseeing administrative hearings or quasi-judicial proceedings.
  • Experience preparing certified administrative records for judicial review.
  • Experience coordinating with the Office of the Attorney General or equivalent legal authority.

Personal Leave - new Stateemployees are awarded six (6) personnel days annually (prorated based on startdate)
