Job Summary

Division Head Prosecutor of Justice Reform/PPD Job Description:
The Office of the Second Judicial District Attorney improves the quality of life of the
citizens of Bernalillo County by reducing crime through thoughtful enforcement of the law and the
development of a criminal justice system. The Office is an Equal Employment Opportunity Employer
and is seeking applicants to serve as an Managing Attorney within the Division of Alternatives to Incarcerationor Diversion.

The Diversion Prosecutor will work with various entities within the Second Judicial District Attorneys
Office to include our Justice Reform team and the Pre-Prosecution Diversion Program to evaluate
cases to identify lower-level offenders to determine the best course of action in reducing recidivism
for the specific offender. The Diversion Prosecutor will work cooperatively with both Metropolitan
Court and District Court to divert the offender through various Specialty and Diversion Courts - both
within Metropolitan and District Court - or through non-court alternatives both inside and outside the
criminal justice system. Ideally the Attorney will have in-depth knowledge of the root causes of
certain crime to include mental health disorders and substance use disorders. Schedule may vary and include on-call duties and occasional evening or weekend work.

The Diversion Prosecutor will implement policy directives from the District Attorney and will regularly
meet with Chief of Policy and Planning Chief Administrative Officer and Pre-Prosecution Diversion
Director to best achieve diversion rehabilitation and reduction in recidivism.
* Knowledge Skills and Abilities:
  • This position requires management of other attorneys and staff.
  • This position requires comprehensive and current knowledge and skills in the areas of criminal prosecution rules of evidence and rules of criminal procedure; public relations; organization and supervision; basic computer skills including working knowledge of office systems; fully effective trial skills; ability to draft legal documents; ability to work effectively with other criminal agencies; ability to communicate effectively; ability to research/analyze information and situations; knowledge of various mental health and substance use disorders is important but not mandatory.
  • Works independently with minimal consultation with supervisors (except for higher profile or complex cases).
  • Significant prosecutorial discretion on cases within assigned caseload.
  • Maintain and track data related to diversion program participation and recidivism outcomes; compile and analyze statistics to support case management program evaluation and office reporting needs.
* Requirements:
  • Career prosecutor: Licensed attorney to practice law in New Mexico plus a minimum of six (6) years of relevant prosecution experience.
  • Managing attorney: Licensed attorney to practice law in New Mexico plus a minimum of six (6) years of relevant prosecution experience which should include two (2) years administrative/management experience.

* Preferred Qualifications:

  • Career prosecutor: Licensed attorney to practice law in New Mexico plus eight (8) or more years of relevant prosecution experience.
  • Managing attorney: Licensed attorney to practice law in New Mexico plus eight (8) or more years of relevant prosecution experience including three (3) or more years of administrative/management experience.
