Start your journey towards success! DPS is currently accepting applications for the position of Deputy General Counsel (Assistant Agency General Counsel II) with the Office of the General Counsel in Raleigh NC.

The Deputy General Counsel (Assistant Agency General Counsel II) develops advanced legal positions in complex legal matters of significant interest to the agency and to the State of North Carolina. This position provides daily oral and written legal advice and counsel to the General Counsel Chief Deputy General Counsel Director of Purchasing and Logistics Director of Communications Executive Directors of several boards and commissions in the department Chief of Staff division heads and other employees on a myriad of topics related to their statutory duties and responsibilities. This position also serves as a liaison to the Attorney Generals Office and provides guidance as necessary or requested regarding statutes policies and rules applicable to pending litigation. This position decides the best legal strategy to use to best achieve the agencys goals.

Primary responsibilities of the position include:
Directing and supervising two (2) attorneys on a daily basis.
Analyzing the strengths and weaknesses of cases to develop effective litigation strategy and arguments to achieve the agencys desired result.
Drafting advisory letters and formal opinions on new or complex legal issues; drafting statutes policies rules and amendments which have a broad impact on programs or create new agency programs.
Monitoring pending litigation involving DPS and provides technical assistance to the Attorney Generals Office in matters related to procurement and public records laws in anticipation of litigation or after litigation is filed.
Providing legal advice to executive and senior management in the areas of procurement and public records laws.
Reviewing public records requests subpoenas (including subpoenas for personnel records juvenile records and law enforcement investigative records) and petitions for release of custodial law enforcement agency recordings.
Drafting and reviewing agency memorandums of agreement and contracts.
Responding to requests from the agencys boards and commissions on Open Meetings laws.
Conducting or directing legal research and analysis of the broad spectrum of legal issues affecting agency action and providing legal advice based on the results of that research and the employees knowledge and experience.
Examining and evaluating federal and state legislation case law administrative rules and regulatory requirements as well as consideration of secondary sources including relevant research articles and treatises.
Representing executive management at mediations and court-hosted settlement conferences (with settlement authority) upon request.
Completing special assignments (usually confidential highly sensitive and urgent in nature) which have been assigned by the Secretary Chief of Staff General Counsel or Chief Deputy General Counsel.
Delivering training to DPS staff on an as-needed basis.

About NCDPS - Office of the General Counsel:
The Office of the General Counsel (OGC) provides to executive management and managers oral and formal written legal opinions on laws constitutional provisions administrative rules and regulations court decisions and other precedents impacting the departments policies and operational procedures. This section drafts departmental rules and regulations operational guidelines contracts department-sponsored legislation and other legal documents. Attorneys in the OGC provide oral and written responses to inquiries by federal state and local officials including legislators judicial officials law enforcement personnel and citizens about the departments policies and practices and the statutes and regulations it enforces. The OGC advises the Secretary and executive management on the merits of litigation against or on behalf of the department.

Recruitment Salary Range: $91249 - $123000

This is a full-time position (40 hours per week) withState Benefits including paid vacation paid sick leave paid holidays retirement and health insurance. DPS uses the Merit-Based Recruitment and Selection Plan to fill positions subject to the State Human Resources Act with the most qualified individuals. The Minimum Education and Experience (E&E) is REQUIRED to qualify for this position. Management Preferences including Knowledge Skills and Abilities (KSAs) are not required but may be used to determine the pool of most qualified applicants. Managers may also choose to interview/select applicants who demonstrate Management Preferences.
