The Delaware Department of Justice (DOJ) Civil Division seeks a Deputy Attorney General (DAG) to represent the Division of Revenue (Revenue) and the Office of Unclaimed Property (OUP) both within the Delaware Department of Finance. This DAG position is in the Civil Divisions Fiscal Integrity and Protection Unit (FIPU) New Castle County. This position offers a unique and dynamic practice with responsibilities primarily split between Revenue and OUP. Few roles provide the opportunity to engage so directly with the legal and fiscal mechanisms that support State government while serving the people of Delaware in a meaningful way.
Essential Functions
The Revenue assignment places the attorney within a teamof experienced Finance DAGs handling matters at the intersection of tax lawadministrative law compliance and public finance. This role is ideal for anattorney who values intellectual rigor public service and substantiveresponsibility and who thrives in a collaborative mission-driven counsel to Revenue the DAG serves as a trusted legal advisor and advocateon matters that directly impact the States fiscal integrity handling complexlegal issues appearing before administrative tribunals and courts and workingclosely with State officials on issues of statewide importance. The positionoffers significant autonomy direct client engagement and the opportunity todevelop deep subject-matter expertise in State taxation and revenueenforcement.
The position alsoincludes representation of OUP in connection with the administration of theStates unclaimed property this capacity the DAG provides counselto the State Escheator on a wide range of matters including the processing andadjudication of unclaimed property claims. The attorney represents the StateEscheator in claim appeal proceedings before the Tax Appeal Board afive-member quasi-judicial tribunal as well as in litigation. The role alsoencompasses advising on procurement and contracting legislation and regulatorymatters Freedom of Information Act compliance personnel issues and otherlegal matters essential to the effective administration of the program.
Prior relevant experience is welcome but not role is well suited for attorneys looking to expand their skill set in asupportive collaborative environment.The DAG will have other duties related to FIPU as well ashandling additional assignments as directed by the State Solicitor DeputyState Solicitor Unit Head or Assistant Unit Head.
Job Requirements
Membership in Delaware Bar is required. The most qualified candidates will have some prior general counsel and litigation experience; however such experience is not required for selection. The DAG should be able to take a proactive approach to assisting its agency clients; therefore a successful candidate should have the ability to work with State agencies to identify potential issues and assist State agencies to address such issues in order to minimize or avoid future legal action. The DAG should be able to work independently meet deadlines and communicate clearly with client agencies and should have demonstrated legal ability and a thorough knowledge of relevant laws and court rules.
The DAG must have a willingness to travel within the State to meet departmental needs and meeting schedules.
