ONA is seeking to hire a Legal Coordinator for our Legal Expense Assistance Plan (LEAP) team to join our Toronto Office. This posting is for an existing vacancy. This position provides LEAP services mentorship advice and support to meet the service delivery needs of ONA and its membership. The incumbent will be a leader on the LEAP Team and is accountable for providing mentorship and advice to lawyers on the team and maintaining an active but reduced file assignment under the direction and supervision of the Senior Manager LEAP Team and WSIB Appeals Team.
This is what else you can expect from this dynamic role:
  • The Legal Coordinator will be required to provide advice on all aspects of the work performed by ONAs LEAP Team including issues of provincial significance.
  • The Legal Coordinator acts as a coordinator and leader on the LEAP Team.
  • During the Managers absence provides non-managerial coverage and strategic advice to ONAs Chief Legal Officer.
  • The Legal Coordinator will be responsible for providing advice guidance and mentorship to members of the LEAP Team in coordination with the Senior Manager LEAP Team and WSIB Appeals Team regarding proceedings before the College of Nurses of Ontario (CNO) and other regulatory bodies. Position may require the incumbent to be generally available and to respond to urgent requests for advice or instruction.
  • They will also be responsible in consultation with the Senior Manager LEAP Team and WSIB Appeals Team for onboarding and training new lawyers to the team.
  • The Legal Coordinator acts as a key resource to the Senior Manager LEAP Team and WSIB Appeals Team LEAP Team and other ONA The Legal Coordinator provides legal and strategic advice to the Senior Manager LEAP Team and WSIB Appeals Team and Team the Litigation Team as well as other teams across the organization.
  • The Legal Coordinator provides strategic and competent representation to ONA and its members at regulatory bodies under the Regulated Health Professions Act (RHPA) tribunals Coroners Inquests Personal Health Information Protection Act (PHIPA) proceedings and the Courts.
  • The Legal Coordinator conducts research prepares written submissions and litigates cases before RHPA tribunals.
  • The Legal Coordinator prepares written opinions legislative submissions research memorandum direction and position statements and other organizational requests
  • The Legal Coordinator represents members in misconduct (Discipline Committee) and health matters (i.e. Fitness to Practice) and generally provides support and guidance to members who are involved in the Nurses Health Program (NHP).
  • The Legal Coordinator coordinates organizes and provides education to other ONA staff and managers.
  • The Legal Coordinator may be required to serve on committees including the NHP Operations Committee and NHP Communications Committee. They also attend and/serve as a resource to ONAs representatives on various committees such as the LEAP Advisory Team.
ORGANIZATIONAL ACCOUNTABILITIES
  • Accountable for meeting the LEAP Team Mandate which includes representing ONA members at regulatory tribunals PHIPA proceedings coroners investigations and inquests assisting with NHP matters providing advice to witnesses and referring members to criminal representation where necessary.
  • Accountable for providing education to ONA members and staff regarding LEAP services and regulatory matters.
  • Accountable for identifying risks and opportunities related to ONA achieving its goals/mandate including identifying issues of common concern to LEAP members before regulatory bodies and strategies to responding
  • Accountable for understanding ONAs strategic outcomes the LEAP Teams objectives and how ones individual role relates to ONAs broader outcomes
  • Accountable for identifying skill knowledge and resource gaps as required to perform tasks
  • Accountable for actively participating as a team member to ensure that organizational accountabilities of the LEAP team are met.
  • Accountable for making observable contributions to the success of other team members and to the overall performance of the team.
  • Accountable to act as a leader and mentor demonstrating a commitment to both the professional and personal growth of the LEAP team.
  • Accountable for participation in the development of educational opportunities within the organization including presentations to staff and the development of other LEAP support resources.
What we are looking for:
The successful candidate will possess
Education and Training
  • LL.B/Juris Doctor (J.D.) is required
  • Called to the Bar of Ontario/Member in good standing with the Law Society of Ontario
  • Education or training in alternative dispute resolution/mediation and/or oral advocacy is an asset
Experience
  • A minimum of 5 to 10 years of experience practicing health professions regulatory law union-side labour law and other relevant areas including administrative law
  • Demonstrated experience in onboarding teaching advising and mentoring junior lawyers
  • Extensive experience advocating at RHPA tribunals including Inquiry Complaints and Reports Committee Discipline Committee and Health Professions Appeal and Review Board
  • Demonstrated advocacy litigation and presentation experience and skills.
Skills
  • Demonstrated skills in coordinating and leading on the LEAP team including acting as an advisor or co-counsel on files with junior lawyers
  • Accountable to demonstrate solid client relations and communication skills and sound professional judgment.
  • Demonstrated ability to draft pleadings and write legal opinions and memoranda
  • Ability to take initiative and work independently. Position requires incumbent to work independently consulting as needed with ONAs leadership team.
  • Ability to mentor provide advice and instructions coordinate and provide support to other team members
  • Ability to provide advice and guidance on files that are not their own.
  • Ability to lead and conduct litigation on behalf of ONA including complex litigation
  • Ability to exercise sound judgment and to develop innovative arguments and solutions to legal issues or challenges that arise on the LEAP Team
  • Must be flexible adaptable and able to work well with others in a team environment.
  • Able to build strong positive working relationships and communicate effectively with ONA staff management internal and external stakeholders including outside counsel nurse consultants and regulatory college staff.
