Main Purpose of Job:
Be responsible for the daily legal affairs of the Von Neumann Research Center(three offices in Zurich Lausanne and Graz) ensure the daily legal compliance and operation of the Von Neumann Research Center refer to key tasks such as contract review intellectual property review legal evaluation of new projects case disputes and legal compliance of the research center and be responsible for the latest legislative updates. You will be part of Huawei Switzerland and global legal team and will therefore have the opportunity to work closely with colleagues across Huawei group to implemented legal best practice.
Key Responsibilities:
Advise the business on a full range of contracting issues ranging from procurement through to research partnerships business development or other business arrangements.
Responsibility for reviewing and drafting general commercial contracts and other documents including NDAs master service agreements master procurement agreements terms and conditions intellectual property related agreements (e.g. research and development contracts with academia or industry IP provisions in commercial agreements) and real estate-related agreements;
Support the business with key areas of statutory compliance including anti-bribery modern slavery data protection and export control;
Provide professional legal advice to senior level management board members and business units on the issues related to the Companys obligations rights risks and organization privileges;
Identify risks and propose alternative options to reduce the risks involved in prospective R&D project;
Collaborate with other departments such as Admin HR Operation Finance Marketing and Professional Development etc. to assure legal adherence for projects;
Coordinate with the companys departments in order to enforce the Companys procedures and policies;
Update the company with recent legislations and legal changes;
Daily check of new legislation related to business;
Provide legislation summary that may impact the business;
Provide bi-monthly legal updates including new legislation and legal trends;
Dispute and litigation resolution/mitigation;
Assist with Debt Settlement/Collection solutions;
Provide support to Tax/Finance department with possible Tax inspection/Audit;
Procurement of law firms for various projects/litigations;
Assist in the Legal Compliance Questionnaire Projects;
Assess perspective law firms for future procurement;
Translate legal documents letters and legislation whenever required;
Support HR department with all labor law related issued and procedures;
Monitor update and apply for all relevant and applicable corporate documents/licenses in due time;
Provide training on newly passed legislation and updates on existing legislation.
Skills and Competencies:
Be able to demonstrate strong commercial awareness and be a team player;
Good command of English (listening speaking & writing) and German;
Strong knowledge of IPR GDPR Swiss FADP Swiss Contract Law Labor laws and relevant litigation experience preferred;
Effective communications skills;
Persuasive and Presentation skills;
Must be able to work in a structured manner;
Developed problem solving abilities
An ability to work closely with a variety of stakeholders on a local and global basis to develop strong working relationships.
Able to explain issues in plain English without legal jargon;
Excellent planning attention to detail organizational and time management skills with the ability to work to tight time schedules prioritizing and handling conflicting demands;
Switzerland qualified solicitor with at least 2 years experience post Swiss legal professional qualification exam either in a Switzerland law firm or in a relevant in-house role at a recognized company/institution.
Preferred requirements:
Previous experience of an in-house environment;
Experience working on cross-border transactions;
Knowledge of employment law and/or real estate issues;
Familiarity with research projects between academia and industry an understanding of university decision-making and stakeholder processes
Experience working on intellectual property matters
Experience of working with Switzerland Government on export control and other trade compliance issues
