Job Duties

Performs appeal functions sanctioned by DOL and the Virginia Unemployment Compensation Act relating to UI claims state set-off debt collection labor disputes disaster relief and under the Treasury Offset Program Trade Readjustment Act and Migrant Seasonal Farm Workers and Dislocated Worker Program.

Conducts administrative law appeal hearings; affirms or reverses initial determination and issues written decisions. Reviews case materials; researches laws regulations policies and precedent decisions; determines necessity of witnesses and subpoenas.

Maintains hearing order and testimony; administers oaths; defines issues appeal rights pertinent laws regulations and policies; conducts direct and cross examinations; rules on admissibility of evidence postponement and continuance motions; records appeal hearing.

Applies knowledge of laws rules regulations pertinent administrative procedures due process standards and legal research methods.

Reviews and/or updates appeal decisions submitted by other staff for legal sufficiency and compliance; researches and resolves complex and technical issues; acts as a resource for other staff regarding correct application of the law; and completes special assignments as directed by the Chief.

Minimum Qualifications

Knowledge of the rules and regulations governing eligibility and qualification for benefits administrative law procedures for conducting hearings due process rights legal research methodology and terminology.

Strong analytical decision making and oral and written communication skills.

Ability to manage substantial caseload conduct fair hearings and control the process; ascertain and evaluate facts; apply related laws and regulations; analyze information; organize facts and testimony into written decisions; proofread identify problems and resolve issues; review the work of others; and work effectively various parties.

Additional Considerations

Knowledge of statutory and regulatory provisions governing unemployment compensation (e.g. Virginia Unemployment Compensation Act).

Experience interpreting relevant laws rules and regulations; conducting UI administrative hearings; and reviewing and editing legal decisions.
