This Senior Prosecutor position is responsible for legal work primarily in the areas of litigation of municipal court cases legal aspects of codes enforcement issues criminal and civil lawsuits involving the city and cases in the District Court and before the Kansas Court of Appeals and the Kansas Supreme Court. Work is performed with latitude for the exercise of independent professional judgment under the supervision and review of the City Attorney. This position has direct supervisory responsibilities and works closely with the Municipal Court Administrator Municipal Court Clerks and the Municipal Court Judge in ensuring efficient and effective operation of the Municipal Court. This position supports all aspects of the Prosecutors office. The hiring range for this full-time exempt position is $100000-$125000 per year (DOQ).
Position Responsibilities
Representation of the City. Works closely with the City Attorney in civil matters involving administrative warrants and abatements. Handles all forfeitures for the police department as well as issues that relate to disposition of police property.
Consultation. Works closely with the Police Department in the investigation and filing of charges. Responds to calls from Police Department personnel to answer questions and/or authorize arrests and detentions. Provides training to Police Officers on numerous aspects of the law. Assists in the preparation and prosecution of cases arising out of City code violations. Renders opinions to City staff and City Council on Shawnee Municipal Code interpretation. Attends Municipal Court/Police Department meetings to participate in court management discussions and develop procedures for improving cohesion between the Police Department Municipal Court and the Prosecutors Office.
Legislative Interpretation. Interprets City codes ordinances and policies. Performs other legal duties related to Municipal Court Police Department or any City department requesting an opinion for interpretation. Remains up-to-date on legislative changes and how such changes affect the City. Writes city ordinances that impact municipal court and attends city council meetings to address the council on the ordinance adoption.
Training. Identifies training needs for law enforcement and code enforcement personnel. Provides up to date legal information to the Police Department in the form of case law statutory changes treatises etc.
Case Prosecution. Aids in the efficient operations of Court. Represents the City in District Court appeals as needed and in the Kansas Court of Appeals and Kansas Supreme Court.
Supervisory and Management. Oversees supervises and evaluates the work of assigned staff. Allocates and integrates work to ensure effective and efficient operations. Trains and counsels employees conducts performance evaluations and works with employees to develop individual goals and objectives for staff development. Monitors expenses and assists in the preparation of the budget for the Prosecutors Office.
Continuing Education. Stays informed of new and pending legal issues. Participates in legal seminars and the preparation of legal papers. Participates in professional associations and meets the requirements set forth by the State of Kansas in continuing legal education hours each year.
Minimum Qualifications
- Juris Doctorate Degree from an accredited college/university
- Member of the Kansas State Courts and the Federal District Court for the District of Kansas
- A Minimum of six (6) years of employment in the practice of law is required. Municipal criminal law or public prosecution experience from comparable entities and supervisory experience are preferred
Work Schedule
In general this exempt full-time position is scheduled 40 hours a week Monday-Friday with varying office hours. Occasional work off-site at District Court responding to emergency calls at all hours and attendance at overnight seminars and conferences are also required.
