Director Litigation - Expression of Interest

The opportunity

The Director leads the Litigation branch a team that is responsible for the enforcement of laws and conducting litigation on behalf of the Environment Protection Authority (EPA).

About you

The ideal candidate will bring a diverse set of skills and experiences including:

  • Proven ability to lead prosecutions civil enforcement and complex litigation
  • Provide clear candid legal advice to Ministers Boards and Senior Executives
  • Represent the EPA in high level negotiations and stakeholder discussions
  • Skilled in briefing and managing external counsel to achieve strong outcomes
  • Experienced in developing policies and procedures that support effective investigation and prosecution functions
  • Committed to ensuring the EPA acts as a model litigant and uses recourses efficiently

Essential requirements

  • Admission or immediate eligibility for admission as a legal practitioner of the Supreme Court of NSW; and holds or is eligible to immediately hold a current unrestricted practicing certificate in NSW
  • Extensive proven experience and high level professional skills in litigation including prosecutions
  • Demonstrated knowledge and expertise in legislation administered by the EPA and relating to criminal and civil enforcement

About the role and team

The EPAs Litigation Team is a high-performing group of specialist in-house lawyers who prosecute and defend EPA cases in Court and who provide legal advice to the EPA across all areas of its work.

The Director Litigation:

  • Leads the conduct of prosecutions civil enforcement and other litigation to enforce laws administered by the EPA and represents the agency when decisions are challenged.
  • Provides expert frank and candid legal advice to the Minister Board Chief Executive Senior Executives and internal stakeholders.
  • Leads and represents where appropriate the EPA in high-level negotiations with external stakeholders.
