Description of Work

Maximum recruitment range: $58673.
This position is bilingual preferred (English & Spanish)
This position is located in Wake County.
The Wage and Hour Bureau of the Department of Labor is charged with the responsibility for administering North Carolina General Statutes Chapter 95 Article 2A known as the Wage and Hour Act Article 5A known as the Private Personnel Services Act Article 5B known as the Job Listing Services Act Article 20 known as the Controlled Substance Examination Regulation Act NCGS Chapter 15A Article 5 known as the Expunction of Records known as the Medical Payment Law and NCGS Chapter 64 Article 2 known as the Verification of Work Authorization Act along with their respective Administrative codes as applicable. Activities include educating and informing employees and employers of their rights and responsibilities investigating complaints auditing businesses and where non-compliance is substantiated taking corrective action in the form of conciliations administrative proceedings civil money penalties back wage calculations and lawsuits as applicable

The Investigator I is responsible for achieving compliance of the Wage and Hour Act E-Verify Act Controlled Substance Examination Regulation Act Expunction of Records Act Private Personnel Service Act by employers. Investigations are conducted either in office and or on-site at the business location. Driving both a state and or privately owned vehicle is required; therefore so is a current valid driver license. All investigations shall include audits of time and payroll records employment policies and practices relating to payment of promised wages jobs and hours worked for minors and other procedural compliance with E-Verify CSERA Expunction and PPS/JLS Acts. Investigators shall interview employers employees or other witnesses to verify the accuracy of records policies and other information obtained during an investigation. The investigator will make decisions as to compliance or violations; compute wages when due negotiating for back wages due and ensuing violations are corrected. Investigators shall prepare a computer-generated report that explains the findings in each case. This report shall include supporting witness statements and other documentary evidence. If back wages or penalties are not paid; the investigator will work with a supervisor the Legal Affairs Division and the Attorney Generals Office to litigate the case as applicable. Investigator(s) shall act as a consultant to employers employees and other citizens to assist in the voluntary compliance with the various laws. The Investigator shall develop and maintain a thorough knowledge of state and federal wage and hour laws and regulations and a general knowledge of the scope and function of other agencies enforcing employment-related laws. The Investigator I shall make oral presentations to the general public when requested on applicable laws as assigned and shall perform other duties not covered that are directed orally or in writing by those within the management structure.

Knowledge Skills and Abilities / Competencies

  • Considerable knowledge of administrative and judicial procedures in state and federal jurisdictions.
  • Demonstrated ability to plan direct and coordinate cases using case management and time planning.
  • Demonstrated experience conducting investigations.
  • Demonstrated experience interpreting laws and statutes preferably with knowledge of labor and employment lawsdirectly affecting the Bureaus legislative mandates particularly the Wage and Hour Act Medical Payment Law Controlled Substance Examination Regulation Act Private Personnel Services Act the Job Listing Services Act E-Verify Act and Expunction of Criminal Records law. Candidates with thorough knowledge of the Fair Labor Standards Act related federal regulations and court opinions and methods procedures and practices used in the investigation of alleged violations are also preferred.
  • This is a Spanish preferred position. Management prefers bilingual candidates that are fluent in speaking reading and writing in both English and Spanish.

Minimum Education and Experience Requirements

Bachelors degree in business accounting or law enforcement from an appropriately accredited institution and two years of experience in work that provides considerable understanding of wage and hour laws or work involving the application of advanced investigative techniques auditing case management; or an equivalent combination of education and experience.
