Position Overview
This position promotes and enforces the Illinois and Federal Motor Carrier Safety Regulations (IMCSR FMCSR) Hazardous Materials Regulations (HMR) and other applicable regulations. The incumbent is responsible for managing an area-wide program and planning and performing a broad range of compliance functions. This position is accountable for the administration of the departments Motor Carrier Safety Assistance Program (MCSAP) encompassing segments of industry engaged in the shipment and transportation of materials over Illinois highways to gain compliance with established safety transportation regulations.
Essential Functions
- Establishes subordinate caseloads and ensures that reviews and proposed actions are consistent with regulations and are supported by evidence gathered.
- Conducts the initial review of New Entrant Safety Audits and Compliance Reviews in order to assign cases in accordance with staff capabilities while monitoring and assigning all complaints and following-up with the Federal Motor Carrier Safety Regulations (FMCSR) to ensure compliance of regulations.
- Monitors the development of each case to be responsive to managerial and legal legislative inquiries and reviews the proposed course of action to determine consistency with precedents established for similar circumstances.
- Ensures that departmental policies and procedures are consistently applied in cases where monetary penalties are recommended while reviewing applicable regulations and making recommendations for revisions to increase levels of compliance and promote a safe transportation environment.
- Reviews all investigative reports to determine and recommend an appropriate course of action to gain industry compliance with the Illinois Motor Carrier Safety Regulations (IMCSR) and FMCSR.
- Works directly with the Commercial Vehicle Safety Section Manager to establish goals and objectives determined by the FMCSR while identifying trends in citations and violations to recommend the development of information and training programs for enforcement and industry personnel in order to increase compliance levels.
- Provides essential information to the Office of Chief Counsel to support the sanction process.
- Monitors regulations and violations to identify the need for regulatory revisions and recommends changes to these regulations to increase compliance levels and promote a safe transportation environment.
- Demonstrates competency and maintains proficiency through successful completion of initial and recurrent training and certification programs as required by state and federal policies.
- Performs duties in compliance with departmental safety rules. Performs all duties in a manner conducive to the fair and equitable treatment of all employees.
- Performs other duties as assigned.
Minimum Qualifications
- Completion of bachelors degree majoring in business administration public administration or a related field plus three years of experience working with the Illinois and Federal Motor Carrier Safety Regulations (IMCSR FMCSR) and Hazardous Materials Regulations (HMR) OR eleven years of experience working with the IMCSR FMCSR and HMR.
Preferred Qualifications
- Supervisory experience.
- Exceptional knowledge of IMCSR FMCSR HMR and other rules and regulations which govern the trucking industry and the transportation of hazardous materials.
- Ability to collect review and comprehend evidence in support of the civil penalty process.
- Ability to plan and direct efforts of employees for efficient accomplishment of program objectives.
Conditions of Employment

- Must attend and successfully pass each of the four core FMCSA courses (NAS A NAS B General Hazardous Materials and New Entrant Safety Audit) to become provisionally certified within the first six months of hire. Then will be expected to successfully complete and pass the remaining two FMCSA required courses (Cargo Tank and Other Bulk Packaging) and become fully FMCSA certified within one year of hire. These courses may require out-of-state travel for training sessions.
- Once obtained must remain fully FMCSA certified throughout employment in this position.
- This position has been found to meet the requirements in section 4A-101 of the Illinois Governmental Ethics Act requiring the occupant/employee to file a Statement of Economic Interest. The Illinois Governmental Ethics Act (5 ILCS 420/4A et seq.) requires certain state officials and employees to file annual Statements of Economic Interest with the Office of the Secretary of State that will be made available for examination and copying by the public. All employees required to file a Statement of Economic Interest are also required to file the Supplemental Statement of Economic Interest with the Executive Ethics Commission. (See Executive Order 15-09) Fines and penalties apply to untimely filings.
- Certain provisions of the revolving door restrictions contained in 5 ILCS 430/5-45 apply to this position. As a result the employee should be aware that if offered non-State employment during state employment or within one year immediately after ending State employment the employee shall prior to accepting any such non-State employment offer notify the Office of the Executive Inspector General for the Agencies of the Illinois Governor (OEIG) or may be subject to a fine.
- Requires a valid drivers license.
- Ability to climb bend and stoop and lift 25 pounds.
- Requires the ability to travel frequently with some overnight stays primarily within the state in order to conduct investigations.
- Requires successful completion of a background screening.
