THE STARTING SALARY FOR THIS POSITION IS LIMITED TO $87849 - $103184.Salary offers for the selected candidate are based on the candidates education and experience related to the position as well as our agency budget and equity.


This position is responsible for representing the Department of Labor in complex civil litigation including handling civil and administrative cases involving various regulatory programs that may involve constitutional issues public policy concerns or issues that may impact economic conditions human resources or a wide segment of the general public. This position requires the ability to analyze the case research plan develop and execute an effective litigation strategy to achieve desired results in novel or complex cases. The litigation is conducted in a variety of forums based on the subject matter of the ligation. OSHA litigation is conducted before the North Carolina Safety and Health Review Commission and North Carolina Superior Courts. Amusement Device Elevator Boiler and certain Wage and Hour proceedings are conducted in the NC Office of Administrative Hearings (0AH). Wage payment and REDA claims are conducted in Superior Court Bankruptcy claims involving wages and penalties are conducted in federal bankruptcy court.


OSHA litigation often involves negotiating and drafting novel or complex settlement stipulations in order to address the often delicate and peculiar hazards existing on employers worksites. The more complex OSHA cases handled by this position typically involve catastrophic accidents such as explosions or the release of highly hazardous chemicals that involve multiple injuries and fatalities.


All of the subject matter litigation involves negotiating and composing briefs (including pre-hearing briefs and post-hearing briefs) motions discovery and settlement agreements and interviewing witnesses (expect and subject matter) in preparation for hearings or trials.


This position requires travel and some overnight travel.

The salary grade for this position is LG08. State employees are encouraged to apply for positions of interest even if the salary grade is the same as or lower than their current position. If selected for this position a new salary will be recalculated taking into consideration the quantity of relevant education and experience funding availability and internal equity. Based upon these factors a pay increase MAY or MAY NOT result.

The Labor Section of the Attorney Generals Office acts as advisor and legal representative to the Commissioner of Labor and the North Carolina Department of Labor.


Department Information:

TheNorth Carolina Department of Justice led by the Attorney General of North Carolina represents the state state agencies and elected officials and defends the rights of the people of North Carolina. The Department handles all state criminal appeals cases and assists district attorneys with complex criminal cases at their request. Additionally the Department of Justice includes theNorth Carolina State Crime Lab theNorth Carolina Justice Academy and theSheriffsandCriminal Justice Education and Training Standards Divisions.

Knowledge Skills and Abilities / Competencies

Minimum Education and Experience Requirements

Licensed to practice law by the North Carolina State Bar and three years of progressively responsible professional legal experience.

NOTE: GS 114-2 and 114-6 make it the duty of the Attorney General of NC to represent the State of North Carolina in all litigation unless another statute specifically states otherwise.
