THE STARTING SALARY FOR THIS POSITION IS LIMITED TO $87849 to $103184. Salary offers for the selected candidate are based on the candidates education and experience related to the position as well as our agency budget and equity.
This position is in the Health and Human Services Division Public Assistance Section.
The primary purpose of the Public Assistance Section is to provide legal services to the following agencies: The Division of Health Benefits of the Department of Health and Human Services The Division of Social Services of the Department of Health and Human Services The Division of Aging and Adult Services of the Department of Health and Human Services Health-related occupational licensing boards and The Social Services Commission.
This position will provide a full range of legal services to the Division of Health Benefits within the Department of Health and Human Services. This position will seek recovery from third parties pursuant to G.S. 108A-57 and must be knowledgeable in all aspects of personal injury law. This position will seek recovery from the estates of former Medicaid recipients pursuant to G.S. 108A-70.5. This position will handle collection efforts from providers who failed to repay overpayments received from Medicaid. Asset searches and evaluations are performed to determine whether it would be cost efficient to pursue collection through civil litigation. In those instances when collection would not be cost efficient certification is prepared by the attorney to address the issue of federal financial participation for the Division of Health Benefits.Licensed to practice law by the North Carolina State Bar and three years of progressively responsible professional legal experience.
Management preferences:
Experience with litigation. Knowledge of Medicaid including Medicaid including Medicaid liens and other public assistance programs. Experience practicing before the Office of Administrative Hearings or other administrative tribunals and in Superior Court.

Credit for foreign degrees will only be given if verification of degree certification is attached to your application. Transcripts for foreign degrees have to be evaluated by an organization like World Education Services to determine US equivalency.
Any licenses or certificates must be included in the appropriate section of the application form.
Applicants seeking Veterans Preference must attach a copy of their DD-214 or discharge orders.
Applicants seeking National Guard Preference must attach a NGB 23A (RPAS) if you are a current member of the NC National Guard in good standing. If you are a former member of the NC National Guard who served for at least 6 years and was discharged under honorable conditions you must attach either a DD256 or NGB 22.
