Course Description:

This course supplements and expands upon the basic introduction to criminal procedure given in CML 1103 and CML 1203 (Criminal Law and Procedure) by examining specific stages of investigative pretrial and trial procedures. A significant part of the course will look at police powers and the impact of the Charter on the investigative process. We will cover trending issues in search and seizure arrest and detention as well as the right to counsel and the right to silence. Topics will likely include carding the search of computers and cell phones police surveillance the challenge of search warrants as well as the dynamics between police and suspects. The trial and pretrial procedures will likely include the right to a trial within a reasonable time as well as the jury selection process.

Requirements:

The Common Law Section is seeking candidates who are leaders in the legal profession. An LL.B. J.D. or equivalent is for this position. Membership in the Law Society of Ontario or equivalent in good standing is also . The successful candidate will have significant practical experience in the area of Canadian criminal law and procedure. This candidate will further be up to date on Canadian criminal law and procedure. Prior teaching experience will be considered an asset.

The Common Law Section reserves the right to select a candidate who does not fully meet each of these requirements where the candidates selection would be beneficial to the program the course the students or for a related reason.

The candidate may be required to teach this course either online inperson or hybrid mode at the discretion of the Faculty and in accordance with public health guidelines.

An acceptable level of education and/or experience could be viewed as being equivalent to the educational required and/or demonstrated experience.
