This position will support WFP Engineering and requires the engagement of a competent Engineering/Legal Contract Manager with a background in both engineering and legal.
The Engineering/Legal Contract Manager shall be able to demonstrate a strong competence with progressively responsible roles in contract management/administration for infrastructure projects (FIDIC form) and legal advice. The Engineering/Legal Contract Manager shall have experience in engineering services and construction activities.
ACCOUNTABILITIES/RESPONSIBILITIES:
Under the general supervision of the Chief Engineer WFP Engineering and within the delegated authority the Engineering/Legal Contract Manager will be responsible for some or all of the following activities dependant on the Units needs:
Contract management / Construction Manual duties
1. Finalize the review and maintenance of the existing WFP Construction Manual identify areas requiring improvement or further clarification and implement the changes required considering all the stakeholders contribution from relevant units such as Procurement Legal Programme etc.
2. Develop guidelines based on the WFP Construction Manual for emergencies and works.
3. Provide expert guidance to engineers at HQ and field to ensure a successful project through utilization of the Construction Manual.
4. Integrate Environmental and Social Sustainability (ESS) Occupational Safety and Healthy (OSH) and Quality Management Plan (QMP) considerations into contractual documents by reviewing and adjusting them accordingly.
5. Support the finalization of the WFP LongTerm Agreement of the contract with FIDIC collaborating with Legal and Procurement.
6. Review the existing WFP set of contract documents for engineering services and construction (FIDIC Form) identify areas for improvement through lessons learnt and feedback from the field and implement the changes required.
7. Contribute to / implement WFP policies standards norms and practices ensuring compliance with wider WFP policies procedures guidelines and operations.
8. Contribute to / implement the revision of the WFP Engineering Directive identify areas for improvement through lessons learnt and feedback from the field.
9. Provide legal and contract management services apply best practices standards and innovative that comply with WFP standards and processes.
10. Support engineers at HQ and in the field with the review of agreements and contracts for consultancy and construction activities. Provide guidance in interpretation of the contract documents. Explain and / or reconcile any ambiguities and / or discrepancies in the contract documents and apply the various provisions of the contract documents.
11. Provide guidance and advice in contractual matters (including but not limited to performance bonds insurances claims advance payment guarantees etc..
Legal Role duties
12. Provide expert advice and support related to development of legal framework and agreement for engineering services and construction related activities within the WFP legal guidelines.
13. Provide expert advice and contract support services considering countryspecific requirements using best practices and standards that comply with WFP standards and processes.
14. Draft legal documents including policies directives agreements and contracts. Study legal questions arising out of the interpretation or application of relevant rules policies conventions and agreements.
15. Review existing legal documents including agreements directives memoranda of understanding commercial contracts and other such texts specific to WFP Engineering and related activities and propose legal advice for any amendments/ changes.
16. Draft complex contracts agreements institutional and operational modalities and developing a new legal modality to meet WFP Engineering needs/circumstances.
17. Identify potential liabilities insurance and professional indemnity requirements particularly related to the management of risks associated with the WFP Engineering activities with third parties and work with other business units in WFP and propose mitigation measures.
18. Conduct contract negotiations with external partners as directed and when required.
Capacity Building and Training duties
19. Prepare and deliver training to WFP members/teams on select topics disciplines within the WFP Project Management framework including WFP regulatory procedures standards of practice and implementation and knowledge area such as Scope Development Time Management Financial Management Quality Processes Stakeholder Management Risk Management Communications Planning Contracts and Procurement Integration.
20. Assist in capacity building of WFP teams with involvement in recruitments and inductions.
21. Provide training guidance and updates on the FIDIC contract format to WFP teams.
22. Undertake field missions at short notice.
23. Undertake any other reasonably related duties as assigned by the supervisor.
QUALIFICATIONS & EXPERIENCE REQUIRED:
Education:
University Degree in Civil Engineering. Postgraduate or Master degree specialization in law.
Qualification to practice or ability to be admitted to practice by a recognized national or state bar or law society is preferred.

Hold or be eligible for Accreditation to Professional Engineer or Chartered Engineer status or recognised equivalent by an appropriate national or international regulatory authority (Not necessary but an advantage).
Experience:
Minimum 15 years of professional experience in development of legal agreements in context of engineering services and construction legal aspects of engineering services/ construction contracts (FIDIC) and thirdparty agreement management and administration.
Field experience or extensive familiarity with contexts similar to WFP operational environments is highly desirable.
Strong knowledge of operational processes/ requirements risks and liabilities and ability to develop solution to mitigate the risks is required.
Knowledge & Skills:
Good written and verbal communication skills in English.
Knowledge and/or experience in engineering design and construction.
Detailed knowledge of consultancy and construction contract formats and contract under FIDIC including assessment of claims.
Good knowledge of public procurement procedures; international contract formats and construction management procedures.
Experience of working within the International Humanitarian Community.
Languages:
International Professional: Fluency (level C) in English language. Intermediate knowledge (level B) of a second official UN language: Arabic Chinese French Russian Spanish and/or WFPs working language Portuguese is considered an advantage.
