Job Description:
WHAT - Summary & Purpose of the Position
To
Provide legal advice and support to all business functions in Algeria &Tunisia.
Support the brand teams on key initiatives ensuring these are implemented in a compliant manner.
Anticipate and proactively secure Ipsen Algeria and Tunisia from a Legal risk perspective.
Implement Global Policies and recommend/develop local policies and positions on Legal issues in alignment with Group Legal.
Provide legal advice and support in relation to data privacy matters as well as informing and educating the Algeria and Tunisia business on their obligations from a local Data Privacy perspective.
Implement projects as decided by Group Legal as well as work done by the Global Data Privacy team (e.g. adapting global policies to local need)
WHAT - Main Responsibilities & Technical Competencies
General:
Provision of general legal advice as needed as well as providing general legal/contracts training to the business as required.
Drafting reviewing negotiating and approving commercial and other agreements as needed including those involving HCPs and HCOs.
Supporting brand teams on key product-related initiatives to ensure these are implemented compliantly.
Updating template bank and legal resources (Contracts Manual etc) as well as managing the Legal Sharepoint site and Legal Inbox.
Prompt intervention to manage contractual conflicts/litigation with assistance of external counsel as needed in coordination with the Legal Director MEAM and Group Legal.
Proactive monitoring of and training stakeholders in relevant changes to local legislation or local requirements in coordination with the Legal Director MEAM.
Flag high-risk areas and raise business awareness around applicable laws and regulations through training and day-to day interactions in coordination with the Legal Director MEAM.
Review promotional materials as required in coordination with Regulatory Affairs and Medical Department.
Ensure overall compliance of Ipsen Algeria and Tunisia activities with all applicable laws in coordination with the Legal Director MEAM.
Proactive monitoring and management of existing relationships and alliances in coordination with the Legal Director MEAM.
Ensure smooth collaboration with cross-functionally business ethics procurement finance commercial medical and regulatory team and Intellectual Property functions.
Support and participation in Group Legal projects as needed (i.e. contract management) in particular for local implementation.
Data Privacy:
Develop and proactively maintain knowledge of data protection and data transfers.
Provision of legal advice in relation to Algerian data privacy matters as well as keeping abreast of all relevant changes in applicable data privacy legislation and providing regular training to all areas of the Algerian business as required.
Supporting the business in maintaining up to date data processing records and advising on DPIAs where required.
Maintaining the record of processing activities and acting as the liaison with the ANPDP
HOW - Knowledge & Experience
Knowledge & Experience (essential):
Strong working knowledge of GDPR and Algeria/Tunisia Data Privacy legislation as well as experience in applying such legislation pragmatically to deliver on business objectives whilst managing risk effectively.
Experienced in drafting analyzing and negotiating a wide variety of commercial and other contracts.
Excellent communicator with good stakeholder management and engagement skills.
Self-motivated team player with excellent interpersonal skills but should be able to work independently.
Solid project management skills including ability to manage projects with minimal supervision and deliver these on time.
Highly organized and able to work under pressure prioritize and meet deadlines; flexibility to meet the needs of a fast-moving business environment.
Confident to offer comments and thoughts at Legal and/or business meetings.
Assertive and able to play an active role as a partner to the business and as a negotiator.
Ability to make difficult decisions and stand behind them.
Willingness to travel for work events / meetings (on occasion).
Knowledge & Experience (preferred):
Experience with the One Trust platform would be an advantage.
Education / Certifications (essential):
Bachelors in law.
Minimum 3-5 years PQE gained either in-house or in private practice.
Experience in Algeria data protection laws and their application.
Education / Certifications (preferred):
Experience in the pharmaceutical sector including the EFPIA Code of Practice would be advantageous
