Overview
ACCOUNTABILITY OBJECTIVE:
The Associate Counsel Employment & Litigation is responsible for working with company leadership to champion the Companys mission vision values and service standards. As a part of the legal team this position is expected to work collaboratively with all levels of team members to improve the team member experience at Diversicare.
Position Summary:
We are seeking an experienced attorney with a strong background in employment and labor law to advise management on HR employment and labor law matters as well as assist on other general legal matters including contract review. The ideal candidate will be a proactive detail-oriented attorney who can manage complex legal issues while contributing to legal strategy and risk mitigation.
Responsibilities
Key Responsibilities:
- Advise leadership and HR on employment and labor law matters including discrimination wage & hour leave of absence laws (FMLA/ADA) and workplace policies.
- Draft review and revise employment agreements separation agreements NDAs and other contracts.
- Represent the organization in administrative proceedings (EEOC DOL OSHA state agencies).
- Manage employment-related litigation from intake through resolution including discovery motions hearings and settlement negotiations.
- In collaboration with outside counsel serve as primary legal advisor on labor relations for unionized healthcare facilities including collective bargaining strategy contract interpretation and administration.
- Lead or support negotiations of collective bargaining agreements with multiple unions as well as manage grievance and arbitration matters arising under collective bargaining agreements.
- Assist with other non-employment litigation as well as other corporate legal matters such as contract review vendor agreements and internal policies.
- Prepare legal memoranda and training materials for internal audiences.
Qualifications
Qualifications:
- Juris Doctor (J.D.) degree with a license to practice law in good standing in at least one U.S. state; admission to the Tennessee Bar is preferred.
- 5 years of litigation experience with a focus on employment and labor law.
- Strong contract drafting and review skills.
- Excellent legal research writing and analytical abilities.
- Proven experience managing litigation and administrative matters.
