Title: Senior Assistant Attorney General (Prosecutor)

Unit: Medicaid Fraud Control

Salary Range: $122500 to $145000

FLSA Status: Exempt

Location: Oklahoma City OK

The Oklahoma Office of the Attorney General is currently seeking a full-time Senior Assistant Attorney General (Prosecutor) for our Medicaid Fraud Control Unit.

Position Summary:

The Oklahoma Medicaid Fraud Control Unit (MFCU) is a state law enforcement division within the Oklahoma Attorney Generals Office and its mission is to investigate and pursue enforcement actions against health care providers who have defrauded the Medicaid program or who have engaged in abuse neglect and/or exploitation of persons in residential health care facilities. The MFCU has both civil and criminal enforcement powers. This attorney in this position will focus on criminal enforcement actions and supervision of the Units prosecuting attorneys.

Typical job functions of this position will include among others:

  • Supervising MFCU prosecuting attorneys

  • Carrying a caseload of prosecutorial cases

  • Working within a team of agents analysts and other attorneys to prosecute abuse neglect and financial exploitation perpetrated against residents in long term care facilities and patients in the Medicaid system in Oklahoma

  • Working within a team of agents analysts and other attorneys to prosecute provider fraud in the Medicaid system

  • Working with Federal partners to conduct investigations and prosecutions

  • Drafting issuing and filing documents such as Subpoenas and Informations

  • Working with agents to prepare Probable Cause Affidavits and Search Warrants

  • Working with administrative personnel to prepare and submit exclusion documentation

  • Preparing and conducting criminal Discovery

  • Motion practice

  • Conducting hearings and trials as needed

  • Networking with and assisting federal and other state counterparts (as appropriate)

  • Working as part of a larger network of MFCUs nationwide

  • Presenting outreach materials to various groups and entities

This position will be as a prosecuting attorney and will be located in northwest Oklahoma City near Northwest 63rd Street and Western Avenue.

The successful candidate for this position will work as a member of an interdisciplinary team of investigative agents auditors/analysts and attorneys pursuing criminal enforcement actions such as incarceration restitution and penalties asset seizure and exclusions from the Medicaid system. The attorney hired for this position will also serve as supervisor to prosecuting attorneys in the Unit.

The successful candidate for this position should have sound legal judgment strong research and writing skills strong analysis skills and the ability to understand and communicate complex and sensitive information and legal issues. The Senior Assistant Attorney General serving in this position will consult with investigators and analysts review evidence prepare and file criminal actions in the appropriate court conduct criminal Discovery draft and respond to motions and other court filings attend hearings negotiate plea agreements and take matters to trial as needed. Additionally the position will involve representing the Office and Unit in criminal investigations and enforcements conducted jointly with Federal counterparts at any of the three U. S. Attorney Offices located in Oklahoma.

The attorney accepting this position must maintain the integrity of the Attorney Generals Office as well as the confidentiality of information as required by the Oklahoma Attorney -state travel including some over-night travel is expected. Also out-of-state training opportunities will be available and included.

Qualifications:

Applicants must be or be eligible to become licensed attorneys in the State of Oklahoma with at least ten (10) years of relevant prosecutorial experience. Applicants without prosecutorial experience should not apply. Strong writing research oral advocacy and organization skills as well as superior attention to detail are required.

The Oklahoma Attorney Generals Office Medicaid Fraud Control Unit receives 75% percent of its funding from the U.S. Department of Health and Human Services under a grant award totaling $4527129.64 for Federal fiscal year (FY) 2025. The remaining 25% percent totaling $1509367.95 for FY 2024 is funded by the State of Oklahoma. The federal fiscal year 2025 is defined as October 1 2024 through September 30 2025.
